You should have an affidavit of heirship prepared so the house and property gets transferred into both your names. Since you legally have a half interest in his property (assuming the property itself was in your father's name) he might be willing to swap his claim for your claim. I retired as ended giving the home back to HSBC however the loan was sold to a second who went to a collection agency (Leading Edge Recovery Solutions). Nearly three months ago, I was in a car accident which was the other driver's fault. I was not sure at the time whether I would be able to work, and was also unsure of the extent of my injuries. I was a pizza driver. I told my boss that I would keep in contact regarding returning to work. I could not because I couldn't drive and I was afraid of re-injuring myself. Now, after three months of physical therapy and doctor's visits through my insurance's PIP, I am sure I wasn't able to return to work because of a back injury I sustained.

Your doctor should be able to verify in writing that you were unable to perform your regular duties, and, hopefully can estimate for how long. Ask him for a letter to go to the PIP handler (with a copy to you). The PIP claims adjuster has most likely already asked him if your injuries interfered with your work duties. It's not too late to re-submit a claim to PIP for lost wages, but the adjuster will need a reason to reverse his previous decision. Which brings me to .... you proving interference with your work duties. Unfortunately it usually takes the support of your employer to confirm with the PIP handler that you were an employee in good standing at the time of the accident and you lost time and wages because of the accident, not for other reasons, like miscommunication. If your employer won't acknowledge that you were a valued employee, and that you did lose time on the job from this accident, then you have a proof problem. It makes it tough to bring a wage loss claim. Factors: were you a valued employee? What is the employer's version of the miscommunication, and when did the alleged miscommunication happen? What is your history with the company? Track down what they say the "miscommunication" is/was. If they terminated you long after the accident, then you may be able to at least bring a wage loss claim for the period of time between the accident and your termination date. Keep working it, and don't give up in your pursuit of justice. All the best,

It sounds like the personal representative no longer wants you in the house. Who would you be cooking or cleaning now for other than yourself? You do not have a right to live in estate property unless you have an agreement with the estate (not the parent who has now died) to do so.

My husband was arrested for possession of a controlled substance (less than 1 g) in July of 2009 in Navarro County. He was given deferred adjudication. He did not get in any more trouble until January of this year when he went in for his appointment with his probation officer and was arrested. He was not keeping up with his appointments and UAs like he was supposed to for the preceding 2 or 3 months according to the allegations so a warrant was issued for his arrest. The DA's best offer has been 12 months. We are unable to afford an attorney and his public defender is advising that he take the 12 months. It seems a little harsh but she says that this particular county just doesn't believe in second chances. Does this ring true or is it likely that he can get a better deal than 12 months?

If your husband did not keep up with his UAs and visits he violated the conditions of his probation. The court has the power to find him guilty and sentence him to the two full years in State Jail.

Find out how experienced his attorney is with this sort of case. What is the basis for her accepting 12 months. What is the experience of the prosecutor and the judge.
If your husband does not like the 12 months he can agree to go open on sentencing. This would leave the sentencing to the judge. Or he can go open with a cap. For example he can agree to a cap of 18 months or 12 months. This would place the sentence between the statutory minimum of 6 months and the cap.
Another consideration is your husband's record. Is this his first offense or is he a career criminal? If he has a long record, 12 months may be a good deal. Also remember the he will get credit for the time he has served in jail. If he has been in jail since January, 12 months is really 6 or 7 more months.

In California, your ex husband is only obligated to pay child support until your daughter turned 18, or up to age 19, if she would have still been a full time high school student living at home. Absent that, you will have to hope that he will contribute because it is the right thing to do.

Second, he must file an action for divorce and, as part of that proceeding, seek an ex parte - emergency order requiring the other parent to return the children to their home state pending a temporary hearing.

My father has been diagnosed with stage 4 bone cancer that is not curable. He has a 9 year old daughter who is my sister. Technically half sister because we have different moms. Her mom is a drug addict and is out of the picture.
My dad is in complete denial of the cancer and at this stage has made no will or anything of the sort.

Hello. You CAN put someone's name on anything including a Deed to a property. The question is really whether the transfer is valid and legally meets the requirements necessary to make the transfer of property valid. Putting someone's name on a Deed is not the only requirement for a Deed to pass title to a property. There must be a DELIVERY of the Deed to the person. There must be valuable consideration (for ex, money). There are a slew of additional requirements.
As far as the "owner" being responsible for claims against the property or bills incurred during the time before the person knew they owned the property, it depends. Taxes on the property are a lien against the property and billed to and owed by the owners. If the "owner" sells the property, the buyer would require that those taxes be paid (as would the title agency involved in the transaction). Bills like electric and phone do not attach to the property so they would necessarily be only against the individual who "used" those services. Judgments or other liens attach to the property if the persons against whom the judgment was obtained owned the property when the judgment was made - or the persons had judgments prior to ownership. Any owners thereafter would be "responsible" to clear these judgments in order to transfer clean title to someone else. This is just a basic answer on this issue - there are a ton of "if's, ands or buts" that cannot be explained in this type of format.
If you were put on a Deed without your knowledge, the transfer may be voidable. If you want to remain on the Deed, equity - or fairness - would argue that your share of any interest should not be diminshed by the "responsibilities" of any co-owners whose personal actions or ommissions created liens on the property. How you would attempt to remove yourself from the Deed or work out any of the lien issues is a matter that would require you to speak at length with a real estate attorney. The facts you gave are not much to work with and the law involving real estate and title liens is very complex.

But that is not dispositive of whether someone needs a will. An estate planning attorney usually wants to know how much, and what kinds of property a person has. Many estate planners advise people to set up a trust, to avoid probate. Without a trust, an estate will still have to go through probate, and distribution is governed by the rules of intestate succession.
An estate planning attorney will often advise the party to have a pour over will, which will distribute property that is later acquired by not funded into the trust. A will is also a good idea with personal property items that the person wants specific directive over, such as heirlooms like grandpa's gold railroad watch, or mother's wedding ring, etc. Otherwise these end up in contentious "divvy" sessions in probate contests.
There are other issues too, such as taxes. I strongly suggest that you and your husband at least speak to an estate planning attorney, if only for a consultation, as doing it yourself can end up being far more costly for your family in the long run.

In a word, yes.
Assuming the department store was responsible, they are liable for both special damages (your daughter's medical bills) and any general damages (like your daughter's pain and suffering).
The fact that Medicaid paid for your daughter's treatment is also not relevant to any settlement or recovery from the department store. What will likely happen is that Medicaid will assert a lien on whatever the department store or its insurer pays out. If a lawyer represents your daughter, a typical distribution is 1/3rd of the recovery goes to Medicaid, another 1/3rd goes to your attorney, and a remaining 1/3rd goes to the daughter.
I am not your attorney, and this is just general advice, but I might advise putting together some sort of demand letter to the department store and attaching useful exhibits like the pictures of your daughter's scar.

2. You need to notify your supervisor now about your "injury" and all about any incident.

I'm not sure what part of the arrest process you are referring to. All crimes require some degree of investigation in order to establish Probable Cause. Then usually an Arrest Warrant is drafted and served on the defendant upon arrest. Other times the person is arrested on the spot and the Warrant is drafted and served after they have been taken into custody. There is a lot to the whole process and I am not sure what exactly you are trying to verify.

If your mom is the owner of the house ( her name is on the deed) and you and your sisters are not , there are very few things you can do. You can file a lawsuit against her, and attempt to get the house from her through the intervention of the court. But if you want to stop the sale, you need to file an order to show cause, with temporary injunction, stopping the sale until the court can hear you case.

Mom does not need your permission to sell it and does not have to give you a first right to buy it. Assets are available not only to beneficiaries but to creditors, so it's only after the exector or administrator is certain the creditors have been paid and any potential claims against the estate resolved, that the assets will be distributed. If the assets are not easily convertable to cash, it may be difficult to distribute the assets according to the will or the laws of intestacy. If assets have to be liquidated to cash, it can add to the time needed. If tax returns need to be filed for the estate, that adds time. Best case scenario around seven months, worst case scenario, years.

If covered by workers compensation, then that should be your remedy. If not, you could sue the agent. If you have health insurance, then you'll likely have to repay it out of any money you'd get from suing the agent. Then there's attorney fees/expenses. You'll have to prove he did it. Lawyers do not become involuntary servants after they serve as your lawyer for 5 years, or because something "might" come up later. There is a reason the lawyer wants to withdraw, so you'll need more than that (such as a a trial scheduled next week). You can file a response, and the Judge might set a hearing at which time you and your lawyer can air your differences to all (including the opposing party). Why would you want a lawyer that you have to force to be your lawyer?

You had ten days to object to your attorney's motion to withdraw. As you stated that she has already mailed the order allowing withdrawal to the judge it seems that time has come and gone. But why would you want to force an attorney to represent you when she clearly wants to withdraw from your case? Most clients are well aware of the reason their attorney wants to withdraw from their case. Usually the client has unrealistic expectations or more likely they have failed to pay their bill. The judge will most likely allow her to withdraw so my advice is to retain new counsel as soon as possible.

Insurance on my phone, a warranty in case of damage and a security package that will lock my phone if it's stolen and attempt to lacate it through gps. So in a nutshell, im being charged for a coverage that they no longer offer, they dont service and isn't even in force! But they continue to collect premium. You don't relate whether you have a real estate agent in this mix or not. If you are represented by an agent that person should be dealing with the earnest money, which should be with the escrow company.
If you are doing this yourself, send a letter to the escrow company by certified return receipt mail and send copies of the letter to the buyer's agent. Include or attach a copy of the purchase and sale agreement, and take a highliter to the section where it says what happens to the earnest money. Reference this in your letter.
If you don't get this resolved in ten days or so, send a copy to the broker who supervises his realtor.
