Find the pass time under the dash or wherever it is by following the remote sensor eye to the box. There is a five wire plug attached to the pass time device. Disconnect this plug. You can take the pass time out now but your car wont start. To solve that, cut the purple and the blue wires from the plug you just disconnected. Strip the insulation off the ends and twist and solder them together. You can use a crimp if you'd like too but solder would be better. Wrap electrical tape over the exposed splice. Cover the end of the plug with tape as well just to be safe. Tie the wires out of the way with a cable tie and put whatever you took apart to get to it back together. You are then done.

If you want to simply disable the device from affecting your starter but leave it in the car so that it will still take codes and "appear" to be working, then leave the device plugged in and just splice the purple and blue wires together as before.

It's probably illegal to do this unless you have paid off you car, so I'd check that first.
If your car is paid off chances are the dealer will remove it for free if you ask since he could then reuse the device and they do cost more to buy than to pay to have removed and installed.

This is probably something that needs to be researched in depth, because of the unusual nature of your grandfather's "death," and you should pay a local attorney for a proper consultation on this issue. The question here is whether your mother predeceased your grandfather. I believe she has, but I can't say for certain without researching the issue.

However, if it works that your mother predeceased your grandfather, then she cannot inherit from him. Therefore, her portion of your grandfather's estate does not go to her estate and the attorney cannot take a portion of your grandfather's estate. As for whether you and your sister will receive a portion of the estate and what that portion consists of, depends on whether your grandfather left a will, and what that will says, or if he "died" intestate.

I'm glad you're being proactive here, as it is always better to deal with warrants on your own time rather than waiting for the law to catch up. Unless you want to sit in jail for awhile, you do NOT want to surrender at your home county; you want to surrender in the county where the offense allegedly occurred. As to the bond, this is one of those areas where it would be to your advantage to have a lawyer retained before surrender. A lawyer can ease the process by being in touch with the bondsmen, Court, DA, and Sheriffs Office, so that you can be processed quickly. Also, a lawyer is much more likely to be able to convince a judge to lower your bond, or even possibly get you a signature (release on recognizance, or ROR) bond without putting up any money.

You may very well be. The tenant is directly liable and would be liable to indemnify you, but what if they let their insurance lapse? You can always be sued for the conduct of your tenants subject to the right to sue your tenant, but if your tenant loses their insurance, you're stuck.

I suggest you consult with an attorney as soon as possible. Removing the children permanently from the home without a court order or consent of your spouse could result in hurting your rights to physical custody.

I'm sorry to hear about what happened to you. To answer your initial question, I don't know if any attorneys will retain an association dispute on a contingency fee basis.

If a party wants to go after their association, much of the case turns on what is in their contract with the association. If the contract specifies that the association is not responsible for the actions of other tenants, then they may be absolved of addressing this issue (although I doubt any court would enforce such a provision).

Assuming someone is a tenant, they have a right to "quiet enjoyment" and "habitability" of the leasehold that the association/neighbor may be violating. And if a person owns a portion of the town home, they may be able to sue their neighbor for damages. But, yes, I believe that under the facts you presented, some relief should be available.

As I've already previously answered, if you want "the change of venue because

the children (now) live in wv", you will need to file a new case in the

appropriate court in West Virginia pursuant to the Uniform Child Custody Jurisdiction Enforcement Act (UCCJEA) which is recognized (as well as codified) in all 50 states.

Your Virginia case(s) will not not transferred to West Virginia under the facts which you've described and the statute of limitations has no bearing whatsoever on your case in the Commonwealth.

(The six month limitation which you've referenced is part of the above referenced UCCJEA)

I am located in California, a little over two years ago I bought an investment property in Indianapolis, Indiana sight unseen suggested to me by someone I trusted. He was not a licensed Realtor himself but his real estate business partner was, and he facilitated the transaction just like an agent. It turned out he completely misrepresented the property, and later had to sell the property at tremendous financial loss. I have filed with the state attorney general a year and half ago, and it has been reviewed by an investigator and forwarded to a state attorney about two months ago. The process is very slow.

I have also talked to an attorney local to where the property is, and he informed it will take about $10,000 to see the whole thing through including trials, but even if I won, collecting might also represent a problem. After thinking about it, it seems to me there should be other options, i.e. I file a lawsuit, and the other person might decide to settle out go the court.

Can someone give me an idea how much it would it take for me file a law suit? I would also appreciate any advice on what my options are at this point. Thank you.

The documents from the transaction and all written representations would need to be reviewed before any opinions could be given. Generally, it is not a good practice to file a lawsuit for the purpose of settlement, rahter a lawsuit should be pursued with the thought that it will go to trial. Otherwise, if a case does not settle, it may be too late to properly prepare.

Additionally, in order to determine what the costs for filing would be, a determination would need to me made concering whether your case meets the jurisdicaitonal requirements for a federal case. If it does, the costs would differ from what a state case would be. Good luck

There is no time limit once an Application for Adjudication has been filed, but it should have been resolved a long time ago. I am not an expert, but I do not know that asbestosis has been shown to be connected to liver cancer. Contact the law firm and demand to know what is happening and get a detailed time table as to when they will act on the case. If they can medically show the connection they will get a large attorney fee so they should have acted a long time ago. You may want to switch law firms

I recommend that you consult with a family law or probate attorney about creating a will that includes provisions for having your boyfriend appointed as your son's guardian in the event of your death or incapacity. I also however feel that you need to carefully consult with your son's father about this action and possibly take the matter to mediation so that your wishes and your son's best interest are taken into consideration. There are a lot of different sets of people and feelings to be negotiated, however doing this work now, and keeping things updated in the event of any significant changes (i.e. you and your friend break up) should allow you to accomplish your goals of having your son supported in the manner that is both in his best interest and consistent with the pattern of caring that has been developed. No will or other estate planning document can do anything more than state a preference for what happens to your child if you die while they are still a minor. You cannot make any legally binding appointment of a guardian or any other enforceable provisions for the child's custody and care. You can create a trust and set up financial arrangments that might give incentives or disincentives to your ex regarding cooperation in appointing a guardian, but ultimately unless he is found to be a legally unfit parent, he will get custody if you die unless he chooses to allow someone else to become the child's guardian.

My client's attorney (who's since moved away) told him that credit unions (at least in the state of Nevada) have no recourse in this situation (unless my client chooses to contact the credit union). Yes you can add your son to your house's title. That said, there are tax consequences to doing it and you may want to consult an attorney to make sure you are getting the result you want. There will be a homestead tax effect as well. You can certainly prepare a will and leave it to him that way. There are other methods for avoiding probate that work as well such as a trust OR transferring a life estate to you and remainder to your son.

As far as we can tell the suspended status means that the partner cannot legally enter into a new contract and if they do it is voidable by the other party. So, do the same rules apply for being a suspended corporation incorporating as part of another corporation? Here we have three corporations. Let's call them X (your corporation); Y, the suspended corporation; and Z, the new corporation which is (at least for now and possibly voidably) co-owned by X and Y.

First, let's be clear that the main purpose of suspending corporations is to oblige them to pay their taxes. Almost all the law concerning suspension and its consequences is in the Revenue and Taxation Code, not the Corporations Code. The most common reasons for suspension are failure to pay franchise taxes or to file a franchise tax return.and, less often perhaps, failure to file a periodic statement of officers, etc. with the Secretary of State.

A suspended corporation can obtain reinstatement by filing the tax return or statement of officers (Corporations Code 2205(d)), paying its taxes and all penalties, and thus obtaining a "certificate of revivor" - Revenue & Taxation Code section 23305. Once it has complied or substantially complied (R&TC;Code 23301, 23301.5) it may prosecute and defend actions even if it has not yet received a certificate of revivor.

So, it is relatively easy for a suspended corporation to get back into the good graces of the law, assuming its managers have some incentive to do so, and some money to pay up.

On the other hand, if your corporation X wants to nullify its voidable contract with corporation Y, X will have to go to court to seek court-ordered rescission, which the court must order, provided (a) corporation Y receives full restitution of any benefits it conferred under the contract, and (b) was allowed a reasonable opportunity to "cure" the voidability. Until a court gives a rescission order, the contract remains enforceable (R&TC;23304.5).

The result in your situation will depend upon how badly Y's owners and managers want to preserve their interests in Y and Z, and whether Y has, or can obtain, the funds needed to pay its tax bills. Also, it will depend upon whether X decides to spend the time and money to take Y to court and whether X can make restitution to Y for any benefits Y has conferred (such as investment in Z) upon X.

In the meantime, assuming Z has filed and paid its taxes and S/S statements, Z is unaffected by Y's suspension and has its full corporate powers, despite Y's situation.

I think an overall analysis of the positions of X, Y and Z should be made to determine whether X should assist Y, take Y to court for rescission, or follow some other course of action. I cannot assume what Y would do, if sued, and advise a course of action without knowing more about Y's resources, the importance of the Z deal to Y, and the quality of the relationship between X and Y.

That depends. The term one needs to look for is Joint Custody. With joint custody no parent has more power than the other, and they are by law to make decisions together. When they don't what your dad did is the outcome.

I know it is hard to watch the fight between your parents but they are frustrated with each other. Sometimes frustrated people do weird things. They just don't believe that each is trying to do what they think is best with the information they have.

Keep your chin up, and try to not let it interfere with the best you can do given what information you have.

One question that comes to mind is who bought your son's belongings. Did your son purchase them from monies he earned through work, or did his dad purchase them? If your son purchased them, perhaps you have more solid ground to stand on in demanding their return.

If not, and if you cannot afford to re-purchase these things, perhaps the wise move is to go to Family Court, get an order of exclusive residential custody in your favor, and in that process call his father out in open court for keeping your son's personal items from him. If he is wise, at that point he will probably return the items rather than have a judge view him as petty and not having his child's best interests at heart.

I disagree. If you are talking about a house, when you go into the house you are guilty of breaking and entering. How can you meet the elements of adverse possession when there is no one claiming ownership. After a while, the assets of the former owner escheat to the State and there is no adverse possession against the government. At some point, someone will probably try to take the house away from you. What greater rights do you have to the house then someone else who just walks in off the street.

There is no such thing as "abandoned" real property in California, according to the Supreme Court. I can't cite the decision at the moment, but it is to the effect that "someone" owns all real property in California.

Next, Mr. Stone is wrong when he says four years. Adverse possesion takes five years. After the five years is up, and you have been in continuous, open and notorious, and adverse possession of the property and paid the taxes all that time, you can then file a suit to quiet title in yourself. Every conceivable person who might claim an ownership interest must be determined, named as a defendant, and served. It isn't easy or cheap.

The meanings of terms in the adverse possession law are somewhat technical. For example, being "in possession" continuously for five years doesn't mean you can't take a trip to the grocery store without interrupting the continuity.

I would consider it extremely risky to try to establish ownership of urban property that seems to be "abandoned" by adverse possession. Among other things, the record owner may reappear in the 59th month and have you arrested for trespass. Bye-bye, four years of tax payments!

I have them prepared but I spent a lot of money on them and I don't want to give them to my spouse until they do the same. My question is: what will a judge do when neither party has exchange any of the documents that the judge ordered us to exchange? I really could care less if I get any of them from my spouse, and I think that they feel the same way. Could we just proceed to Trial without exchanging any of these documents?

One can only assume that both of you are trying to litigate without attorneys - because if there were an attorney involved the issue of failing to exchange required discovery would be a major issue already. Also, unless your case is extremely unusual it's hard to understand how you could have spent a lot of money on the documents.

If it is unusual and there are significant economic assets at play you should certainly be working with an attorney - failing to exchange documents indicates you're making mistakes that could cause serious problems when you attempt to go to trial.

I had medical emergencies, and my son with my fiance was born 3 months early, and she was in the hospital in critical care. I am a carpenter and I always have a difficult winter. So my question is, I am backed up almost 10,000 on child support. I have a letter in to modify the amount of $375 a week for one child, and i am in the process of setting up a payment plan with DCF. This has to do with family, specifically custody for one child. My daughter's father was absent the majority of our two year old daughter. He has filed for a petition to legitimation which I didn't oppose to because I encourage he spends time with her. We have made the parenting plan proposal & agreed on days he could come see her BUT we did not agree on unsupervised visitation. Only on Tuesdays & Saturday were chosen since those are his only days off, which he rarely came. The mediator asked when he could get unsupervised visitation...we agreed PROBABLY after he's gotten to know her enough so we agreed MAYBE when we go to court if he has made the effort to see her, he would be granted unsupervised visitation. He did not show up as planned, he was always coming at 9pm or later on his "off" days, I just didn't see why he wanted to file if he wasnt ready to. We went to court on the 16th of April & he was granted the legitimation. Now he still fails to show up during the times he asked for but he still wants to take her outside the home unsupervised. My daughter has no room, no clothes, not even a car seat within his possession so I refused for two reasons: he doesn't have the necessary items to take care of her nor does she quite know him. So I made suggestions to wean her from me to him, but he wants his way & is threatening that he will take me to court if I choose to not follow his request. I have not prevented him to see his daughter but he'd rather just take her. Will he be granted unsupervised visits? Even with those reasons I stated above?

Little in your post gives a reason a judge would require long term supervision (and we don't know what your order says), so what you left out matters more than what you posted. You also gave us no details as to what was signed in the present order. Additionally, you do NOT have a legal problem at this time. If a case happened just 12 days ago, it is very unlikely a court will hear another case now. You're reacting to a case that does not exist, and you can't respond to that.

Since I am sure your child is important to you, you certainly got a lawyer in your past case, and that lawyer is where you should direct your questions, as he has read the paperwork.

There are very few people dedicated to 8 track collecting. Vintage music collectors prefer records because they do not degrade and are easier to maintain. 8 tracks on the other hand eventually disintegrate and are not considered a long term storage medium for quality sound.

The only people who buy them are generally interested in them as historical pieces and tend towards collecting a wider range of music and sound equipment, hence audiophile communities and those who collect music and radio equipment, not just records.

Beyond that most people tend to end up with 8 track collections more by accident, handed down from a relative. You will have a hard time finding buyers; you can find tons of old 8 tracks being sold at libraries and pawn shops for 25 to 50 cents, and they rarely sell.

Well she repeatedly has sent emails to their "HR" department asking what the maternity policy is for the company. I quoted "HR", because it seems like this company doesn't have a formal HR department.
