Because real property usually can't be divided, so that's why it is sold to give the beneficiaries their equal shares. If the beneficiaries all wanted to own the property together, it probably didn't need to be sold. Personal property left to one beneficiary obviously doesn't need to be divided.

He attempted suicide before his trial. He went to a local hospital psych ward. The sherriffs department removed him from the pshych ward for breaking his bond by attempting suicide. They removed him from the hospital psych ward and took him to the county jail.

He took a plea deal and went to a state correctional facility. He attempted suicide one time that we know of at that facility. Possibly more. They put him in the psych area.

He then went to another correctional facility and was put in the psych ward. We are not sure how many times he attempted in that facility, but did end up hanging himself and dying. He was left alone in his cell.

His wife and 3 little boys saw him one week before. She said he was so drugged up he could not even focus. They increased his dosage after she saw him. She things the meds drove him to it.

Additional information

They took him from a safe place against our will where he was getting psychiatric care. They put him in the psych ward where he was supposed to be safe,and they left him alone. His wife pulled up info about a suicide in January in the facilty where he commited suicide the end of July.

All of this happened in a 6 month period. He had 1 year and six months left on his sentence.

His wife and 3 minor children want to sue for mental anguish, lost income, etc.

His parents and brother and sister want to sue for mental anguish and funeral costs.

These are very difficult cases and depending on who had control of the prison you may not have the right to a jury trial. These cases can be won but it will not be easy. The State of Ohio has immunities from certain kinds of lawsuits filed against it. It should come as no surprise that persons who are incarcerated have even fewer rights than other Ohioans. A time share is an actual ownership in a specific apartment but only for specific weeks of the year, i.e., Unit #104, weeks 12 & 13. You should possess a deed with a legal description in it, just like if you owned a condominium.

If they have displaced you from your ownership, you may have legal recourse.

The problem is that your argument is based on "he said/she said" unless you have something in writing. They have signed paperwork and your title. They could have repo'd the car for non-payment and $1500 (but they did not HAVE to) might be a lot less than you would owe them otherwise.

Do have recourse for what? If you owed the money, then you owe the money. Read your paperwork. These pawn title places are ripoffs - the interest rates are exorbitant . Usually, they just repossess your car but your may not have made it worthwhile to do so. That does not mean that they are not owed the money though. They are a lienholder until they are removed from the title.

And what kind of place just agrees to remove themselves off the title? You admit you owed money and that you did not pay it.

You need to get answers and find out what is owed on the vehicle and figure out, if your vehicle was insured, what you will get. If you will get back less than what is owed, I would not bother and let the pawn title place seek reimbursement. Either than or settle the claim with the pawn title, get them to release the title and make the best deal you can with the insurer.

Your question doesn't provide enough facts, and leaves one to wonder what you want to do, and why.

One possible guess is that you inherited the house and want to take money out, but can't because title still stands in the name of your parent(s). If this is the case, some further information would be necessary such as whether you inherited by will or the house was transferred to you via a living trust, or perhaps your parent had no will and you are claiming ownership under the laws of intestate succession. Another possibility is that you are a surviving joint tenant.

The procedure is different in each case. It may be possible to change the record title at the recorder's office by filling out and recording a form, but probably not, and in any case you would need the assistance of a lawyer to advise you that filing a form is indeed all you need to do.

So, my advice is to see a local lawyer in your town or county who specializes in administration of estates, and pay for a little basic advice.

In Jan. 2003 a friend was sentenced on two counts, the first was a 10 year sentence with an 85% minimum and a restriction of work release as the first step in the parole process .The second was a straight 10 year. They were to be served consecutively.

My friend went to work release in July 2010, was paroled in March 2011 and had parole revoked March. 2012 and was returned to prison on a 2 years owi, which discharged November 2012. My friend has been granted a gradual release (30 day work release) but is being told that parole was not considered- but must return to work release because the 10/85 crime which requires a work release. This hearing was held July 2013 and I just can't understand how a 10 year sentence could still be in effect 10 years and 7 months later. Also the DOC says the first count (10/85) does not discharge until 2016.

My friend is asking when the first count discharged, and assuming it could not have been any later than Jan. 2013, 10 years after sentencing, but has been told that is not correct because it was a they consider it only as a 20 year sentence.

We understand the Parole Board can do what they feel is best, we are only trying to find out which sentences are active and which have discharged because the second count cannot begin accumulating good time until the first discharges. Do two 10 year sentences served consecutively both discharge in 20 years(not taking earned time into account) or does one discharge and then the other start. And can the Board impose standards for release based on a sentence that has discharged. Again, we realize the Board is within their rights to make any decision they see fit and can keep someone in prison for the entire sentence, I am only trying to figure out if that first sentence is gone.

Sorry for the confusing language, but I don't want my friend to suffer for me questioning the procedures.

Parts of your question are unclear. Was the Trust amended twice, three times, or are the amendments as to their petition? I have no idea if the original trust was irrevocable or could be legally amended. A motion to dismiss can not be filed; you should demand a hearing on the petition and a decision by the judge that there is no basis for the petition or a trial on that issue if the judge will not rule [probably will not because they are entitled to a trial]. Ask your own attorney what the fastest and cheapest way of resolving the matter is; normally people do not pay their own attorney to go after hopeless cases. First, if the land is in the Catskills, I assume that it is in NY, not PA. Regardless, you need to find out what county/state the land is located in and get a copy of the deed. Many county deed offices are online. Look up the deed using your father's name as grantor and grantee to see what comes up. If the deeds' office is not online, then call. Start checking with the county where you think it is located and if that does not work then try the surrounding counties. Eventually you will find it. All you need is the name of your father, not the property address.

Your question implies there are an issue with the property taxes. What kind of an issue? If you are getting a tax bill, then the information would be on the bill. Where are the bills going if not to you as the property owner and why do you think there is a problem?

When did your father die? Where did he live at the time of his death? Was an estate ever probated for him? Have you checked with the probate court in the county/state where an estate would be pending? The probate court is called the surrogate's court in New York and the Orphans' Court in PA. Once you know where your father lived and if he has an estate, you can check the court file to see if it mentions the Catskill property. This may also give you a clue. You can also try contacting the tax collector's office and providing your father's name to see if a property comes up.

No response to our third letter making the same request. Wouldn't the lawyer for my stepfather provide the notice/governing trust instrument and file the petitions for the family allowance and potentially the elective share? It would not affect the limitations period for criminal cases.

If your probation officer has filed a report of probation violations, the judge will hold a hearing and decide what to do. S/he could sentence you to incarceration but s/he is not required to do so. For example, the judge could just keep you on probation.

Basically, I changed lanes from the right at the same time someone was changing lanes from the left and the sides of our cars made contact. There were no injuries, however there was damage to the side of both cars.

The accident literally occurred one block from the rental car facility. Therefore, a representative from the rental car agency assisted me and the other involved party with our exchange of information and paperwork. I live in New York City and do not own a car, so I always purchase insurance when renting a car. After the accident, the rental car agent stated "don't worry, you purchased the insurance" which was overheard by the other party involved as they were standing right there. The other party seemed very happy to learn this information, although we never discussed fault or liability for the accident. A police report was not filed.

As far as I knew, the matter was settled between the rental car agency, their insurer, and the other party involved in the accident. I never heard from anyone regarding the matter until today, some 9 months later. I just received a voice mail message from a law firm which represents the rental car agency. They stated "you might have thought that you purchased full coverage, but your rental agreement only covered CDW and not liability." They informed me that the other party would like to get their car fixed and that I needed to call back with my insurance information.

I managed to locate my copy of the rental agreement. Although I asked for full coverage, they only included CDW and unfortunately I did not notice that during the checkout process. My question is, how is liability determined in such a case? Do I need to retain a lawyer in California in order to make contact with the firm representing the rental car agency?

The car rental companies are very unfair. They offer multiple different and confusing coverages, their employees don't understand the coverages and neither do the customers. The hospital said that they would go after State Farm to get the remainder $7,500 back and if State Farm didn't pay it, then I would be responsible for it. You need to speak to a personal injury attorney about this asap. You just don't want it reported on your credit rating while they sit back and fight over who owes what. The dispute between Cigna and your UM carrier is not going to be your biggest concern in the end.

This has to be done through what is known as a "Motion" under NJ Court Rule 7:9-4(a). It sounds like you have compelling circumstances to present a successful Motion. I suggest that you hire an experienced lawyer for the best chance at success.

No, she needs to file a property declaration that she signs. Sounds like she could be hiding assets that she doesn't want you to know about. What a property declaration does is put everything out on the table that is being divided. If you don't claim it on that property declaration form, it can be argued that that asset has not been divided, and it protects the person who has been taken advantage of by one spouse hiding assets from the other.

The hotel signed for receiving the packages and didn't deliver them to her, even though she kept asking for them, till her checkout. She specifically said not to accept any packages for her after her checkout. I contacted the hotel after she left, they said they had 4 packages that were delivered for her and claim they were delivered after she checked out, even though I have the tracking for them all saying otherwise. The manager of the hotel that contacted me said they couldn't send me the packages,even if I paid for shipping, I had to schedule a pick up but no mailing company accepts my billing address. One of these packages is for baby clothes and by the time I get it my kid will probably have outgrown them. Hello I am in Illinois. In March 2014 I wanted to purchase a used engine through a friend's mechanic(his shop). I was quoted $1500 for the engine and installation. I gave him $350 cash deposit with the intention of paying the remaining the balance with my April 2014 tax return. In the meantime, my friend had car problems and gave him $200 for her repair and parts. He disappeared and no one could get a hold of him. I finally stopped at his home May, 13, 2014 stating that I was not going to proceed with the engine repair and I would like my deposit back. He said he would check into it. I called him today May 22nd and he informs me that the shop is holding the deposit until they can find a new buyer for the engine. That seems awfully fishy and I'm not sure if that is even legal, especially it looks like he disappeared on purpose. Do I legally have a case. There was no written contract at all, let alone no notification that said if I didn't go thru with the purchase, they would hold my deposit until further notice. I think I had a good reason to break the contract considering how he disappeared after getting $200 from my friend, which to this date she has not received any money back and ended up junking her mini-van.

You can sue, but only for your money back, because a contract for any product or services over $500 must be in writing to be enforceable. Contracts can be terminated the way they are created (orally). However it's going to be a matter of proof -- proof of the deal, proof of your payment, proof that if you broke the deal and the guy claims damages (lost profit) he might not be entitled to it. But really, the problem here is that you may wind up spending as much on a losing case in court fees and lost time, and even if you win collecting from him sounds like it will be difficult too, and take more time and money. I'm sure $500 is not chump change for you, but in the court system, it is a drop in the bucket. You might have more luck going to the police with the gal who had the $200 taken, and report him as a scam artist. You may get no money back, but you may get some "moral" satisfaction. I disagree with the previous answers. The first question that must be asked is whether the trust is revocable. Most are, but if it is not, your father CANNOT take the proceeds out of the trust. They must be deposited in an account in the name of the trust.

Second, even if the trust is revocable, it must either be revoked, or at least the property deeded out of the trust before the sale closes, OR the proceeds must be placed in an account belonging to the trust and then removed later if he wishes.
