Hello,

The creditors who hold the judgments would have to go through a process of filing those judgments in Florida. This is called domesticating the judgments. If that happens, you will have notice of it. If they do that, then the judgments will become enforceable in Florida and the creditors could ask the Sheriff's Office to seize your vehicle and sell it. You have a $1,000 exemption in a vehicle, meaning that you can keep $1,000 in value from any car. If your car is worth less than $1,000, then it would not be sold. If it is worth more than $1,000, then you would get $1,000 back out of the sale and the rest would go to the creditor to pay down the judgment. You may be eligible for other exemptions too.

You may want to consider filing for bankruptcy. That would likely wipe out the judgments entirely. Our office is local and we offer a free initial consultation. We would be happy to discuss the situation with you.

You can try to prove you didn't make the report, but it sounds like the landlord just wants you out, and will stop at nothing to make trouble for you. If you can't afford to move, then you can try asserting your rights, but you see it is a right not to be evicted because you asserted your tenant rights. Here the landlord knows enough to avoid that trap; instead the landlord is creating a totally different reason to make your life miserable. If the landlord continues this behavior, you could have an attorney write a letter for you to the landlord; at least it may protect you if the landlord then tries something else...since the biggest mistake most people make is not putting things in writing that can protect them later....

I told him my husband has emotionally abused me and committed adultery as described by Texas law through internet porn both live and not. He has done this our entire marriage. He has also kept all of accounts, money, vehicles, everything separate. He had cash on hand of $35000 and CD's worth $20000. This is just what I am aware of. He stole everything he wanted out of the home after filing. He made two to five times as much as I did and had me pay my own way and half of bills at places we shared while working the same place.

During discovery he denied the cash, cd's, stolen items, hidden accounts, just about everything. Other than the information I had and submitted my lawyer did absolutely nothing to get information about accounts I proved he had. He didn't check out the cd's....nothing. he said I had to pay for subpoenas separately but has never told me which ones he needed. He said we are going for fault like I wanted and then he has changed it and said we are going for half the home as I have a written letter from my husband stating his home and property are half mine.

In the meantime, this has been going on for over a year, I have absolute proof of adultery and spending of community property money on girlfriend. Husband decided to offer me the entire home, everything in my possession, some money towards one of our vehicles.

When they sent rule 11 agreement it said he got personal items and property in his possession and the few items he admitted he had. When the final draft comes it states he gets furniture, furnishings, all kinds of stuff. Rule 11 said he got bank accounts but final says cash, savings accounts, other institutions. Rule 11 said he'd pay back taxes and final didn't mention it. Rule 11 said nothing about him getting to keep any retirement plans except pre marriage union benefits yet final had this on there. When I complained to lawyer he told me I wasn't going to get a better deal and sign if I wanted the house. I.refused until Rule 11 mirrors final. He then sent changes I submitted to husband's attorney and am waiting on new final.

My question is this. I already had a letter saying I owned half of home and property, have proof of adultery, proof of hidden assets, proof of spending on girlfriend so why is it that my lawyer thinks that getting the home is enough. If you add up all the assets husband stole, vehicles he keeps, cash, CD's known, and his income this year ALONE I'm getting screwed out of over $50,000. Is this normal? I'm not getting a disproportionate amount in my favor and the opposite is true. Why isn't my lawyer fighting for this? Why did he suggest I sign an obviously different final decree?

We were supposed to have a trial by jury, rare, and lawyer was doing that part for free. I paid for regular judge trial. If he believed in me enough to do jury trial then why have me settle for less than half in the end?

I suggest that you go talk to another lawyer and have him review the entirety of your situation. There may be a very good reason for your lawyer doing what he's doing, except he's not good at communicating with you.

On the other hand, it may be time to fire your lawyer and hire a new one. Remember that you hired the lawyer, and he works for you; you aren't married to him. People switch lawyers all the time.

Not to be snarky or rude, but you do not have rights so much as responsibilities. Your responsibility is to pay. That is why co-signing is such a bad idea. When you co-sign, you are promising the lender that if the borrower fails to pay, then you will pay.

Is this a private or federal student loan? If private, then you can file bankruptcy if you do not want to pay and the loan will be discharged. If its a federal student loan, then most student loans cannot be discharged in bankruptcy unless there is real financial hardship (there are court cases defining what this is).

If neither you nor the borrower pay, they can garnish your wages. If you get the loan paid off, then you can sue the borrower to recover the funds. Or you can just try and get the borrower to pay up now.

If you decide it is located in Delaware, use your Delaware address. I'm sure Delaware requires you to have a registered agent there. So, if you lack any other address, use that.

If the decisions are being made in California, the money from revenues flows to California, the money to pay bills flows from California, etc., I would say the company is doing business in California and is liable to register here as a foreign LLC and pay the franchise tax. Using what you call your "personal address" for your federal EIN will be just another element of evidence that California registration was required.

One sometimes-useful test of what state you're doing business in is to ask yourself, if your LLC needed to sue a national company, and thus had your choice of forum states, where would the LLC file suit?

Possibly, but it would depend on the facts. If your husband was ordered to pay $4,300 a month in spousal support he was obviously making a very good living. If it was permanent he can't modify it, but this is fairly rare. Can they come after you? Maybe. If your husband quit his job because you are making a lot of money you may be, indirectly, responsible. Let us say you make $500,000 a year at your new business, you used marital funds to capitalize that business, and your husband is now working for your business (at minimum wage, but he comes home to a million dollar estate), and you pay for everything he (and you) is going to be responsible. I have no idea if this is the situation, but just food for thought. Basically, if your husband chose to take a cut in pay nothing is going to change.

If you, your siblings and your mother's sister collaborated to determine a fair compensation, and your brother is unhappy about this, perhaps the best solution would be for your mother to continue (or return) to reside in the board and care home provided that she is/had been receiving good care there and it is affordable for her. It sounds as though you and the others put a lot of thought into an appropriate monthly compensation because you have come up with a very precise figure of $2,589. As your brother is unhappy with this, I would be concerned that he may not provide your mother with the best care. However, if having your mother continue to reside in the board and care home is unfeasible, it might also be beneficial for all of you, including your brother, to revisit the fee again in an effort to reach a resolution of this issue.

It's unclear who the third party is who is reviewing your mother's finances but if it is an accounting professional or an independent person with financial background, it is in everyone's best interest that you are having that done. You do not have a high diploma and will not be able to obtain employment that will allow you to support yourself and baby. You should talk with your mother about you finishing high school and obtaining job skills.

What your problems at home will seem trivial when you are living on the streets and have no way to obtain employment. This situation could result in CPS becoming involved, which would further complicate your life.

This included the fair market value (55,000) of an additional rental property Condominium which is collateralized by a non recourse debt for 148,000 and a recourse debt for 13,000. My accountant is telling me that because the condo includes a non recourse debt in the amount of $148,00 I will have a significant amount of income remaining from the 1099C. This does not make sense to me as the 1099C has resulted from the sale of the house not the condo. I'm not sure if this accountant has done an insolvency claim before. Yes, it can very definitely happen in Texas without the wife ever having live here, as long as the husband's been here at least six months. He would have to make at least some kind of attempt at service, but if her address is unknown, that may end up not amounting to much. But, you obviously know about it, so I'm not sure what of all that applies. Having some doctor say whatever like that in a note is not going to get you anywhere at all. Lots of people would rather not have to go through a divorce. Texas law basically says that you don't have a choice--if he wants a divorce, he's going to get a divorce. If you don't like the proposed terms, realistically, you're going to have to hire an attorney and contest it.

Oh, gosh, what a mess! Do you have a signed lease with the prospective tenants? There is a big clash of rights developing here.

If the house were still owned by a living trust set up by your mother before her death, and you were the successor trustee, you would have the sole right to determine who lives in the house, subject to the usual limitations on a trustee's discretion, and you could certainly rent it out.

However, your facts are pretty clear that the trust has distributed the ownership of the house to the beneficiaries, your sister and you. As co-owners, both of you are entitled to possession of the entire house and every room and inch thereof. You are roommates. Further, each of you has the right to surrender your right of possession to a tenant. You can rent, and your sister can rent. Neither of you, acting alone, can rent more than you've got, which is a shared possessory right. However, there are two other factors to consider. First, your sister seems to have given you an agency to act on your behalf by agreeing to allow you to rent the house. This could amount to her yielding her right of co-possession and allowing you to rent the entire possessory interest to the tenants.

The other thing is that having a shared right to occupancy and being allowed to exercise that right are two different things. A co-owner who is out of possession is not allowed to use self-help to move in and avail herself of her right of co-possession. Once Owner X, or someone such as a tenant deriving rights from Owner X's lease, is in actual possession of the property, Owner Y cannot simply move in against the will of Owner X or Owner X's tenant. Owner Y must go to court, claim an ouster, and get an order for shared possession. See Civil Code section 843 regarding ouster and action for restoration of possession.

Based on either the agency principle, I'd say the tenants probably have the right to sole possession, although it isn't clear they can exercise the right unless they move in and get actual possession before your sister moves in. If she get there first, the tenants can't move in, even though they may have the theoretical right to sole possession and at least a right to shared possession.

I hope you can explain this to your sister in time to avoid a confrontation. Too bad you don't have a written agreement. Contracts between co-owners prevail over the basic unmodified rights of co-owners discussed here. Contact me directly if you need further assistance.

You can probably go to the police station and tell them you need to amend a prior statement. I would suggest you try to avoid (if you can) telling them specifically why you need to modify, just that you feel it is important to clarify, add to, alter the prior statement to ensure completeness and accuracy. If you need to say you want to recant, its not the end of the world. Then, tell the truth, the whole truth and nothing but.

If you believe in good faith that the allegation is true, go to the police. Keep in mind you have already admitted the child has problems, and have been told she needs help. The police will have to be convinced of the truth through evidence and facts. You can also hire counsel to bring a civil suit if you can prove the allegation.

You should hire an attorney to go down there, see what is going on, and look in the record for you. Sorry, but no, it doesn't work that way. They will sometimes do that for federal inmates, and even for state probationers, but I've never heard of that working with state prisons, which are all completely separate in their administration and funding between the different states. I guess a good analogy would be going to your boss at Wal-Mart and saying you needed a transfer because your wife was moving to Idaho. They might be able to set something up for you at another Target in Idaho (like tge federal transfers), but there wouldn't be any way to "transfer" to the Wal-Mart down the street from that Target, because, like prisons of different state governments, it wouldn't be run by the same people.

I've been trying for a week to get my release/first offender paperwork from my PO but he's avoiding me, and having contacted the judge's office I know that my paperwork has not been sent there. I have absolutely no violations or fines to pay. With no foreseeable resolution in sight, I'm wondering if I am still subject to the terms of my probation or am I back to being a citizen with rights? And also if there is any way to circumvent my PO and get this mess handled so I can start the process of rebuilding my life?

Your own post contains the answer. You started on December 2 trying to get something that legally could not be commenced until December 5, and it is only 4 days later now. In pestering the judge, which is completely inappropriate, and then the PO, you probably have succeeded in annoying them where they may slow things down. If the paperwork isn't done in the next month or two, THEN you can follow up. Until then, leave them alone so they can do their job.

Just because you have not reached your PO, does not mean yoru PO is avoiding you. Your PO cannot collect anymore money from you, and wants you off his/her supervision list. I suspect that the PO is processing the paperwork. I'm curious: If the PO has had a family emergency like a death in the family, would you realize how self absorbed you still are (even after the 5 years on probation) in thinking that you are somehow the reason he has been unavailable. Probably not. No foreseeable resolution in sight will turn into resolved in a matter of days. What are you looking to do that you cannot do? Carry a gun is the only thing I can think of. If you have been on reporting probation for five years, you either have violated your probation a number of times or have a sex offense. The maximum period of supervision is two years. You indicated that you have violations, so you were either illegally on reporting probation for the last three years, or you have a sex offense. I don't know what the sex offense was about, but the tone of the question indicates that you lack patience, lack empathy and are extremely self absorbed, maybe even bordering on narcissitic. Have you not been rebuilding your life for the last five years while you have been on probation? If it is a sex offense, you better make sure you are registered if required, or you will right back on probation. Good luck.
