Calvary's Tree got together in the beginning of September, 2010. They performed Mahalo nights at the teen club Ohana Pier located in Slidell LA on November 20th & December 12th. Their last performance was at a lock in in Houma LA at Bayou Blue Assembly of God in January before they unpredictably split due to personal problems. Original Members were Jonathan Koeppel (lead guitar, lead vocals), Cory Gilford (rhythm guitar, vocals), Katie Caminita (keyboard, vocals), Sarah Ford (vocals), Sam Kackley (bass guitar), & Joshua Kackley (drums) respectively.

Calvary's Tree members Sarah Ford and Katie Caminita started reforming the band, adding new people to fill in the slots of needed areas, and attempting to start over with a new way of handling things, shortly afterward in March, 2011, and performed once again at Ohana Pier April 9th with the new group: Patrick McKelroy (lead guitar, vocals), Sarah Ford (vocals), Katie Caminita (keyboard, vocals), Dillion Sprague (bass, rythem guitar), & Joey Lizana (drums, backup vocals).

I was cited for parking in a permit stall in a parking structure. I went to the vending machine to pay for parking. The first thing I did was input my stall #. The machine did not ask for a permit #, did not offer to sell me a monthly pass and did not tell me I was parked in a permit stall. It did ask for the daily parking fee, which I paid and the machine accepted. (I have the receipt) My question is: Is there a legal theory that says that if a vender accepts payment with full knowledge of the conditions, he is barred from claiming damages?

The machine is there to accept payments. It isn't there to enforce the law. I suppose it could be programmed to verify that anyone who uses a handicapped spot is eligible, but the law does not require such programming. Besides, a program that imposed added burdens on handicapped drivers would be unfair -- and might very well be illegal.

That you parked where you weren't allowed to is your fault, not management's. The fact that their computer did not realize what you were doing doesn't excuse your violation, or limit management's rights.

It's possible that the court or the plaintiff might dismiss the case for lack of prosecution after a while. Depending on whether the statute of limitation will have run, you might then be legally protected from refiling of the lawsuit.

i have a civil judgment on my credit report from 6 yrs ago. originally i had thought this was paid for by my boyfriend/roommate, but it turns out he only pd 60% or so. then after recv'g a recent credit report i noticed this judgement is set to expire next yr, so i was just going to let it do that cause i heard if i tried to settle the SOL would start all over again.

anyway, he was granted a judgement of $5018.00, $3000 of which has been pd. however, my credit report still reflects the full amt due. we have gone to Phili family court for more info. and were told we'd have to set a court date to settle with the landlord any amt pd. we figure a lawyer may help, but after finding a couple litigation lawyers specializing in landlord/tenant and debtor rights, we have been told to simply contact the landlord directly to settle the amt and then get the appropriate paperwork filed. is this the best way? what if the landlord denies receiving funds? if he does, i assume we will have to go back to court, but if he still denies it 'under oath' and we can prove otherwise, do we have any cause for a dismissal of sorts? i am also wondering about any interest tacked on, can anyone give me an est. of % and how it is charged (i.e. per yr?)

Judgments generally are satisfied or they are not. Partial payments typically don't show up on court records.

You are treading on dangerous ground here Ga. Grandpa. As a 21 year old, your granddaughter is considered an adult in the State of Georgia and can make her own decisions regarding her body. That includes the right to have a hysterectomy performed. Of course, if a court of law has appointed a guardian on her behalf to make decisions concerning her health and welfare, the situation may be entirely different.

Here's just a few of the myriad of potential problem I see --

(1) Your granddaughter will have to consent to any medical treatment she receives and many medical facilities will not perform this type of procedure on someone who is mentally challenged for fear of future liability. And for good reason. If the procedure is performed and your grand daughter later claims she was coerced or didn't consent the hospital has a problem.

(2) If you pay your granddaughter the money and she decides not to go through with the procedure, no court will uphold your agreement as an enforceable contract. For one, a court may say that she doesn't have the mental capacity to contract (since a contract takes a "meeting of the minds" to form and you have already stated she is mentally challenged). In addition, these types of contracts simply go against the public policy of the State --no court is going to order her to live up to her end of the deal if she changes her mind. Finally, even if she does go through with the procedure, there's always the chance she can successfully have her "tubes untied" at a later point in time and you will be right back in the same position.

(3) You don't want to get in a situation where she, or the police, accuse you of a criminal act involving a mentally challenged person.

Before you do anything, I STRONGLY encourage you to consult a Georgia family law attorney who has experience dealing with cases involving adult mentally challenged family members. Most will give you a free consultation and explain your options if any (and the cost, if the attorney helps you).

If there was an arrest, it is public information. The proper person to request information from would be the DA or clerk of court, depending on how far the case has progressed. However, if the case is still being investigated or if prosecution is not completed, it will depend on the reason for your request as to whether it is granted at this time.

That is the short answer. You don't relate a lot of facts. Is there a promissory note which he signed? Was the loan payable in installments? Or on demand? Has a written demand been made? Has he made any repayments at all? How were the repayments made if at all? How long has it been since he last paid or was supposed to pay? What is the balance owed? Where does he live, NC or out of state?

Depending on the answers, that will dictate what you do next. If no written demand has been made (email does not count), then send it by some means where you can prove it (like certified mail). People play games with certified mail so I prefer UPS or FedEx. It costs more but it is so worth it.

Ask for some kind of response. If he does not respond, then, if the amount owed is $5000 or less, you can sue him in small claims on your own. Sue him in the county where he resides. If he lives out of state, you will either need to sue him in the state where he lives or here, if NC had jurisdiction over him. If he does not own any property here, then I would not sue here even if NC had jurisdiction as any judgment entered in NC would have to be transferred to where he does have property. Some states allow wage garnishment, but NC does not. If he owes more than $5000, then you will need an attorney to sue him in regular court. You will either need an NC attorney if he lives here or an attorney in the county/state where he lives. Any general civil litigation attorney, preferably one who specializes in collections, should be able to help you.

I do not know what you mean by "she will not let me." Do you have a key? Has she told you not to trespass on her property? Has she threatened you?

Send her a letter by UPS/FedEx (too many people play games with certified mail). In the letter, outline the difficulties you have had in retrieving your possessions and tell her that you would like to make a final attempt. Set forth a specific time and date and indicate that you will be there to retrieve your possessions at that time so she needs to make arrangements to permit you access to the property. If that is inconvenient for her, advise her to call and give you a time and date or call you so that you can arrange for a mutually convenient time. Tell her that if she fails to respond, you will assume the date specified is ok.

Show up on the time and date and bring a friend with you, preferably one with a video camera. If she gets ugly when you arrive, videotape her refusing you access. Go to the local magistrate and see if you can file a complaint to retrieve your property. You may be able to file a protection from abuse petition if you can show that your mother has threatened or abused you in some way. If not, see if the magistrate's court will allow you to bring a replevin action. FACTS:

1. All I got so far was reimbursement of the costs. (I had paid for the boss' flight, rented the car, paid for our hotels and later his hotels and once also some other subcontractor's stay in London upon the boss' request. Also purchased a new Garvin GPS for driving in Europe... That was all reimbursed.

2. But not a single Dollar towards my actual labor!

3. The boss promised to transfer $ 1,000 by April 1st this month to my account in CA. And I called him when the usual Wells Fargo Bank's e-mail about the transfer failed to materialize.

4. He said he was driving and he cut me off, saying "I was just paid TODAY" and that he "would make the payment". (My bank has a branch in his small mountain resort town, so he could just combine the payment with grocery shopping).

5. It's now the 2nd and the guy owes me

$ 3,000 for work in Germany and $ 1,500 for work in India (originally only $ 1,250 but he was pleased with my performance and I mailed him my original receipts from the hotel, the car service, the flight as requested).

Sorry about the long-winded introduction.

Q1: AFAIK, a corporation must be a going concern and be able to meet its obligations to third parties. Otherwise, we would have zombie corporations messing with all its stakeholders.

(Never got some document saying I'm a subcontractor, but I gave him my SSN). But due to non-payment for labor, I don't expect a 1099-MISC for 2013...)

At this point, I'm unhappy with the whole situation and feel that the guy is giving me the sucker treatment. The promised $ 1,000 would be less than 25% of the unpaid bill for labor.

A major problem with our copyright system is that copyright is automatic. That is, you may have thought you were publishing your work without copyright, but by law, copyright attaches automatically, as in "all rights reserved," unless you do something in writing to change that. It is, in my view, a serious imbalance that abridges freedom of speech, but it has not yet been challenged or changed.

So, the works you already made are copyrighted by you unless you specifically dedicate them to the public domain and leave a paper trail to that effect. (Billions of people create copyrighted works on a regular basis, and might love for their work to "go viral," yet never stop to think that, under the current system, others may not dare reproduce them or otherwise disseminate them for fear of getting sued for thousands of dollars in "statutory damages."

Your "free software" objective (free as in freedom, not free as in beer) is laudable, but because of the way the copyright system is biased, you will have to take measures to make sure your works are treated the way you want. One approach is to consider a "Creative Commons" license. There are many kinds, and the website is pretty straightforward in describing them. It does not sound like a head gasket to me. I would check the oil if you see clear bubbles or it is foamy, in my experience that would be a blown head gasket.Is the floor on the passenger side wet=heater core is bad. Are you losing water? Where? Did you replace the thermostat? Hope this helped.

I has a question in regards to my daughter who is 7 years old. My ex husband and I got a divorce last may of 2011. AT the time, my 7 year old daughter was attending a private school. Although my ex makes a large sum of money, he refused to pay for her school and my mother and myself paid for it (even though after alimony, I still received under poverty level). The reason of importance is she has had many medical issues and goes to a school that can address that. On the divorce decree, he wrote out that he is not responsible for paying for her commencing may 2011. It also states we are to make joint decisions on her school.

Now--for the coming year, I applied for financial aid from the school and they granted me half. He refuses to sign the contract with the school to allow her to go next year even if I agree to pay her whole tuition. The ereason is that our younger daughter got accepted at this school but her tuition will be full price and he refuses to pay for it even though it is not even a 25th of his wages.

I was wondering if I could get the school to allow for just me to sign the contract and if I can legally keep her there? WHat would I file with the courts to make sure she can stay? He wanst our two daughters to go to a school together, as do i, but if it means public school, I would rather keep my 7 year old at private school because of her medical needs and uprooting her after she has gone through this divorce, a move, pneumonia, and other medical issues, would have a deep effect on her well being. On my first visit to the specialist I was told not to go back to work because I needed immediate surgery. I called my employer right after my employment and told her the situation. She told me to feel better soon and sounded annoyed that I would be out of work for seven weeks.

I called my employer the following week to get a letter for food stamps stating that I was on medical leave. My employer told me she could not write the letter for me because I no longer worked there.

I asked her if I was fired and she said no. I then said that I did not quit so how can I no longer work there. She replied that they are a small business and do not offer leave of any kind.

1. He add you as an additional "conservator" of the child. You would have the right to establish the child's residence and claim her on your taxes.

2. I suspect that the judge will order him to maintain her on health insurance and the parents (mom and dad) would pay 100% of the medical out-of-pocket costs. Grandparents are not expected to support their grandchildren. In the State of Texas, parents are expected under the TX Family Code to support their children.

3. Mom and Dad would also be ordered to pay child support until she graduates from high school or turns 18 - whichever is later. If the child is disabled and can never support herself, you would need to have the child support extended past the usual age of 18 or high school. In Texas, parents can be ordered to pay child support for the entire child's life if the child cannot ever be expected to support herself.

4. You need to find the money for an attorney. You desperately need help. You obviously do not understand Texas law. The father is attempting to manipulate you. I even begged with the officer not to press charges but they did anyway, and sent a warrant out for his arrest. The officer said I could drop the charges, but as I began to read online its not that simple. How would I go about dropping the charges and talking to the prosecutors. Basically give me some ways I could get his charges drop or at least talk to the prosecuors about getting them dropped? I mean we both were arguing and this never happened in the past and I didnt tell the cops that i got the bloody lip from when i was trying to push him back, but instead tripped on some clothes in the floor and fell on the floor (my teeth had cut my lip) I think the police just wrote it down ass if he just up and beat me, because my lip was bleeding. The officer who said you could drop charges was not only wrong but acted so inappropriately that you need to talk to his commander and request that he be investigated, as he should not be a cop having said that.

Absuers almost never stop abusing and you are describing someone who will likely eventually seriously harm or kill you and your children. You need to get far away from such an evil dangerous person, and you need extensive mental health counseling to determine why you would attempt to "drop charges."

You can try to file a police report if you choose ...but you'd probably have to lie if you did that, since you (guys) were the actual "instigator" or "cause" here, i.e., without doing what you were doing, none of this would have happened. The generally regarding joint checking accounts is that the surviving person gets to inherit what is in the account. The joint checking account funds pass outside of probate. However, if the estate is short of cash, it may need to reclaim the funds into the estate to pay the bills of the estate. In such case the fundsd would be used to pay estate expenses which may or may be fore the repairs to the house.

It also depends on which of the women made the deposits and which of them died. If the survivor could show that she is the one who made the deposits and that this was her money all along, then maybe the estate would not be able to reclaim the funds even if needed.

You also don't indicate how the house was titled. If the house was solely in the name of the deceased woman, then the house would go to the daughter as per the will. But the daughter does not get a right to raid the joint checking.

You do not indicate if you are the daughreer or the surviving partner. If you are the executor, then I would take the will to a probate attorney and get advice regarding probate of the estate and what the executor is or is not allowed to do. I would also see what actual or potential claims there would be against the estate and review what funds are available to pay those claims. If there is not enough money, claims are paid in order of priority. In discussing this, Iwould advise the lawyer about the joint account and see whether any or all of the funds can be reclaimed by the estate.

If you are the surviving partner, I would also have the will reviewed and advise the lawyer about the joint checking account. I would not spend any funds in the joint account until it is determined that t the estate does not need the funds to pay expenses.

The other child, 15 years old, was stopped three times by a teacher from attempting to assault my son. On the fourth time, the student slipped by the teacher and swung at my son, who partially blocked the punch. The officer said it was not in violation of the ex father in law to text me about trespassing however it is a fine line but not enough evidence to be violation of restraining order. It is also a fine line that we are in violation of trespassing by dropping his grand daughter off.

Based upon what you posted, it appears that the father-in-law was iwrong, but not unleaful and does not seem to have committed any crime. According to you, the father, not grandfather, is the respondent/recipient of the Restraining Order. The Grandfather is not restrained from contacting you. But, if there was a reasoable likelihhod that the father would be at his father's house when your fiance dropped off the child, you may have violated the Restraining Order. Your calling the police to report that you went with her to transfer custody to the father (albeit at grandfather's house) may be the evidence the father needs to have the Restraining Order lifted. If yoru car was jsut in the street (and never pulled into grandfather's driveway) you wre not tresspassing. But, if you ever go in the property now, you will be guilty of tresspassing, as you have been told you are not allowed.

If they have no probable cause, I don't see why your friend has a court date. He got a Court date because he is alleged to have done something wrong at the check point...he needs to speak to a traffic or criminal defense attorney.

It depends. Generally items in garbage dumpsters are abandoned property so it isn't theft, but the dumpsters could be on private property and so there could still be trespassing charges.

In the prenup I signed, it states that any property purchased during our marriage would be considered joint ownership, but he just purchased a condo at the beach and I am not on the deed and will not have any rights to the property.

Do I have legal legs to stand on nulling the prenup and/or when we divorce, receiving any benefit from the condo?
