If my hubby and I divorce, he's military, who would most likely get the children? And, if I want sole physical and legal custody, does that mean he doesn't have to pay child support? Also, I've been the primary caregiver to our children, and have not worked in that timeframe. Am I entitled to marital support as well?



Answer

Who gets the children depends on what is in their best interests. If your husband's career requires him to be deployed out of the country for significant time periods, all other things being equal, that would seem to suggest that you would be in a better position to provide stability for the children. If you are awarded sole physical custody, he would have to pay support, and it would be in the form of a direct allotment to you after entry of a court order. Whether you got sole or shared legal custody would not affect child support. As for spousal support/alimony, you sound like a good candidate for that, but it might be rehabilitative, which means for a period of time necessary to allow you to acquire the skills to reenter the job market and become self supporting. Or it could be permanent depending on how long you have been married, and other factors such relative health, age and what caused the marital breakup.

Sorry to learn of your recent loss.

The short answer to your question is no; presuming your uncle's real estate is part of his probate estate (typically if he was the sole owner on the deed) you will not be able to close the sale.

This problem would eventually be discovered by the title company as they prepare for closing and issuing of title insurance; and, of course, because your uncle is not able to sign a deed to the buyer, the buyer will not be able to receive marketable title.

As you suspected in your question, the remedy to this problem is to have your uncle's will probated and have the Court appoint you as the Executor. Technically, you should have done this prior to entering both the real estate listing agreement and any purchase agreement with potential buyer. These issues can be remedied pretty easily by re-executing the agreements after you have been appointed, or by an addendum to the original agreements, with proof of your appointment as the Executor.

I would recommend that you promptly contact an experienced probate lawyer to review the whole situation and help you fix it quickly, so hopefully you will not lose the potential buyer.

You will have to file for eviction in Landlord/Tenant court. It is unlawful in NJ to evict a tenant yourself and, if you do that, you may be liable to the tenant for damages even though she owes rent.

In February of last year i got my Driver's Permit. I unfortunantly couldnt pay for the rest of my Behind the Wheel Driving Course's, so the Permit eventually expired and i lost it.

About a month ago I went to the DMV and took the test to get another permit. I then took my three Behind the Wheel Course's and got my certificate.

Two days ago i went to the DMV, gave them all my information and papers, took the California Driver's test and i passed. When i went to the window to recieve my license the lady noticed that my new permit was only a month old.

I tried to explain to her that i had my previous permit for a year and that it should be in their system. The lady told me that it only says that I "APPlIED" for the first permit but it had no additional information. So they basically told me that they cant prove that i have had a permit for 6 months because its not in their sysetm.

I called the head DMV office and they said that when you get a new Permit it erases the information of the old one, so that is why they cannot see the old one.

Ive already passsed the test and it does show that i did apply for that first permit. Is there anyway i can get my license? I already passed the test, wouldnt that mean they made a mistake and are kinda obligated to give me my license?

Unfortunately, the DMV is kinda obligated to follow its own rules, silly as they may be. If you were to hire a lawyer and take them to court, you might win, but that would be expensive and time-consuming. So, unless you are a crusader and willing to spend the time and money to kick the DMV where it hurts, I think you're stuck with accepting their ruling.

Banks have a right of set-off against any funds you have on deposit. You do a lot of whining about this but do not put forth any relevant details. It would be really important to know why the bank grabbed the money in your bank account. They did not wake up one morning and take funds out because they felt like it. They took the money because you either bounced checks or otherwise owed them or else you had a judgment against you and your bank accounts were garnished.

Which gets back to you - it is YOUR responsibility to know how much money is in your bank account at any time. You need to take steps to insure that you do not overdraw your account or else get overdraft protection. And if your bank account was garnished, then this is your responsibility too because you would have known (in most cases) that a judgment was entered and you took no steps to protect yourself.

And banks don't care about your personal financial hardships. If the bank is owed money or served with a garnishment, they can take the funds.

I don't understand the rest of the post about adding a wife and so on. If you value having this bank account, then I would talk to the branch manager about having them honor the checks that are outstanding and see if you and the bank can work out some kind of reasonable payment plan so that the bank will honor your checks or give you some money back and you will make payments on the money owed.

If the bank will not budge and your checks bounce, then try to work things out with the merchants with whom you dealt. Go and bank somewhere else (do it quick because if you owe any money to the bank they will list you in Chex Systems and you will not be able to open an account anywhere). Then repay the first bank whenever you do have the funds. And stop any direct deposits going into that account as the bank may grab those too. And stop any auto-drafts from coming out so no more overdrafts will occur.

Hedges were over 6ft. high and hanging over my stockade wooden fence that was falling down. My handymen took down the fence and cut the hedges about a foot from the ground because at 4 ft, they looked bad(no green, just wooden stems). I replaced the fence with a chain link one. You should take that letter to a lawyer who handles real property law. There are a few things that you would need to explain in order for a lawyer to answer your question. The first thing would be, who does the lawyer represent the town or a neighbor? Also, what are they claiming you did wrong in the letter?

Unfortunately, if he has the "lingerie" pictures as you indicate, this highlights the problems with letting people take these kinds of pictures. The law hasn't really caught up to this. There is not much that can really be done, especially once those pictures get out there. Now if your gf is a minor and those pictures get spread and that are illicit or provocative in nature, a criminal complaint may be appropriate for child pornography against the ex. The problem is that if he lives out of state, then the laws of the state he lives in may apply.

If he ever engages in conduct that puts your gf in fear for her safety or life, then she can ask for a civil protection order with the Court, free of charge, but again, if he lives in another state and doesn't come to NC, that may not provide much protection.

There is a VERY limited statute in New Hampshire addressing common law relationships. Additional information would be needed to determine if your Father's girlfriend qualifies as a spouse. I am a little confused as the question you asked seems to contradict some of the statements you made. If you are the other partner and you want your name off the deed, then you simply need to deed your interest to the other partner.

If you want your name off of the mortgage, that will require a refinance or an agreement from the bank that they will let you off the hook...which you will never get.

Hire an attorney to try to negotiate a civil compromise agreement that will guarantee they won't file charges. They can't offer that, but your attorney can. When she went to file her taxes for her self, the tax agent said our best bet to increase our chances for a refund was to file togther, but for my wife to file with form 8857, "innocent spouse form." Supposedly this expemts my wife from my tax liability.

My question, since we filed together in 2011 and in 2012 I filed for chptr 13 with the owed taxes under my chpter 13 umbrella, if we file together again in 2012 along with the 8857, can the IRS try to go after my wife for the 2011 taxes owed? sort of a back-door way of going around my 13?

Why don't you order the title work now, to make sure that there are no current liens. If there aren't any, or if you will be paying them off at the closing, you can provide a warranty deed.

The new title insurance commitment, reviewed by your closing attorney, will give you the assurance you need to warrant the title to the buyer. It is unlikely that in an arms-length transaction the buyer(s) will accept anything less than a warranty deed.

The difference in the two is that if there is a defect in title, you were not assured about it. First and foremost, it is always difficult to predict the timing and result of a case and it is unethical for an attorney to promise any sort of results in a criminal matter. Your ability to receive a refund on your fees will depend on your contract. If you feel that the particular attorney has somehow cheated you, you should bring up the issue with him or her first and if you are not able to resolve it, the Florida Bar has a hotline that helps clients and attorneys resolve problems. They are going to have to speak to an attorney. Under federal law, loan modification evaluation is supposed to take place before the foreclosure process begins. Unfortunately, the federal law, and California state law counterparts, do not have any teeth for enforcement, and the courts have not created or enforced the procedures very strictly against lenders.

Even if the decree does not impose a geographic restriction, you can ask that one be imposed based on the conenction you have with your children. If you visit frequently and are an integral party of their lives, you have a chance of prevailing. Otherwise, you probably will not.

If what you say is correct, it sounds like somebody is not doing their job properly. This should have been wrapped up a long time ago. Putting the property on the market for 3 months is not long enough. Maybe the property was priced too high? Or maybe its in a bad area or needs some work. Whatever, it needed to be on the market longer than 3 months. Letting the insurance lapse was a BAD idea. What if vandals set fire and destroy the house? I the market is not right to sell, renting might be an option, but that should not delay closure of the estate.

What I would do is make a copy of the will and the estate file and pay a probate attorney to review the file. You will need an attorney in the county/state where the estate is pending.

You should go to the District Justice's Office who issued the judgment and request his staff to issue a Writ of Execution. The local constable or sheriff will then go to your ex's home, serve him with a Writ and take an Inventory of his belongings. These belongings will then beseized by the constable/sheriff and put up for sheriff's sale approximately 30 days after the Writ is served on your Ex. Depending on what these items sell for you will then be paid the amount of your judgment as well as all the costs you have paid the court.

The question is 1) do you know your ex's present location and is he still in PA. If the answer to both of these questions is yes, you should have no problem. I am a 34 y.o.male. I am Indian and am currently living in India. However, I am due for an L1 sponsorship later this year to California. I have been married for about 10 years and have a 7 y.o. son who both live with me in India.

I am keen on pursuing a divorce in the shortest possible time. At the same time I would like to sponsor a green card for my wife and son. How long will it take me to get a green card for myself? How long will it take for me to sponsor the green card for my wife (who will be on L2, she does not work) and child? I want to divorce and move the Green card application simultaneously.

I am aware that if I do file for divorce I may not be able to file for their green card. I have the following questions:

With regards to your divorce & child custody questions, there is the issue of jurisdiction. You need to consult with a Family Law attorney in the State you will be residing in regarding dissolving your marriage & custody issues in the United States.

It could take a while for you (& your family) to get a greencard as a multinational executive or manager (or specialized skills worker), & your wife would not be eligible to apply as your derivative spouse once you apply for dissolution of the marriage. However, a child under 21 will always be eligible as your derivative.

As for your wife being sponsored by her relatives, even if you get divorced, it would still take about 7 years for her to get a greencard through a U.S. citizen parent, & 12 years through a U.S. citizen sibling.
