Thank you for reading my question. I was pulled over yesterday by the California highway partrol with the argument that I invaded a side lane of the freeway while merging onto another freeway. This officer's explanation was unclear and he quickly jumped into intimidation as I continued to ask for clarification on why he stopped me. He asked me to step out of the car and focused on how I had alcoholic breath. He conducted some sobriety tests such as walking a straight line and lifting one leg while staring at it and counting, to figure it out whether or not I was impaired by alcohol to drive.

After I performed all the tasks he requested with ease, I questioned him on why he continued to detain me. He then returned to intimidation by stating that his patience was running short with me. After that he handcuffed me and utilized the breathalyzer test. Without showing me the results, he stated that I failed to pass the breathalyzer test and took me to the CHP office without mentioning my rights.

At the station, my car was searched and eventually one of the officers came back with a bag of personal items that were in the trunk of my car such as phone cables, ids, my watch, and wallet. While in the CHP station, him and two other officers addressed me in a condecsending and disrespectful way and made racist remarks about my place of birth. Over an hour later, I was released to family.

After we left and reached home, the same officer who pulled me over called me and left a message stating that I forgot a couple of items, that I needed them, and that I had to return to the CHP station. When I called to ask specifically about the items, he said that it was not a personal item but instead that he forgot to have me sign a form to appear in court for this charge. I asked what would happen if I did not come back for that signature and he responded, "There would be a warrant issued for your arrest. Feeling that I had no other choice, I returned to the station to sign the form. While at the CHP station the second time, the same officer stated that he was doing me a favor by having me sign this form rather than taking me to the county jail for 72 hours.

I am unsure about what to do in this situation. This is my first DUI with no previous convictions or misdemeanors. I was not speeding and there were no containers in the car or other substances. This is a great concern to me since I am currently unemployed and it will hinder my ability to obtain employment. Do I just appear in court on the date provided on the form or is this a case that has some solution in my favor from the way things occurred? Thank you for your help.

You should go to court on the date listed. You should either take an attorney with you, ask for more time to get an attorney, or request that an attorney be appointed. After you get an attorney you can talk with the attorney about your options.

Unless you've been paying rent, you will be a trespasser immediately upon her having the right to exclusive possession. At that point she will have the right to have the police remove you with no further legal proceedings.

As you know she is in tarrant county due to a parole violation for not taking her medication. First I would like to say she has never been properly medicated through the prison system for the last year she has been there. And she is wrongly in prison in the first place.

My sister has been disabled since she was in her twenties due to bipolar and schitzophrenia and has been on diablility since then, Also in her thirties she was beaten raped and almost died in 2004. After being in a coma for over 6 months with a feeding tube, she had to learn how to walk, talk and learn basic functions all over again with permanent brian damage to her frontal lobes which affects her desision making,memory and balance.

Considering she is in jail for DUI incidents is crazy since even sober she could not pass a sobriety test. Sharon Wilson gave her the choice between hospital or 8 years in prison last year and her not on meds told her F you so she gave her prison + 2 years for the F you, which if someone is mentally ill why would you give them a choice? I think that is a horrible desision made by anyone much less a judge.

But here we are stuck in the legal system with her instead of a hospital. She is sitting in there deteriorating mentally and physicaly which is not right. She has been committed several times against her will by myself and my mother and Father and through Trinity springs after being admitted to JPS several times.

I hope and pray you can help me get my sister where she needs to be which is in a hospital not prison. Please contact me and let me know what I need to do.

Probably not. You had no real criminal intent, were not selling the drugs, and trying to help someone out with a medical condition. Unless you live in a small town where the police have nothing to do, they will consider this too minor to worry about. Do not stir anything up by calling the police or District Attorney's Office to see what is going on. See if the school is willing to expunge your suspension if you keep out of any trouble for the rest of the school year.

My question is regarding my rights to regaining my possessions which were confiscated during a parole search in order to ascertain whether they were stolen or not. the police never issued a list nor receipt for multiple electronics , cell phones, pda etc.

I was arrested and by the police for one of the phones coming back stolen and later released by my parole officer. My parole officer is more or less on my side as far as it being a petty attempt on their part, and pretty much knows the phone was not actually mine but one that i was working on. If the property is being held as evidence for new charges, you are not going to get those back, especially if one of the phones was stolen. Additionally, property held as evidence is held until the time to appeal has run on any new charges filed, or any appeal is resolved.

The truck is yours. DO NOT sign it over to your brother-in-law as this will constitute a gift by you and subject to to gift taxes if the truck is worth more than $13,000.

When a person makes a will, it does not become operative until the person dies. That means it can be changed up until death. The will can be changed by various methods. including disposing of one of the bequests in the will by some means (gift, sale or destruction). When your father sold you the car, he thus worked a change in the terms of his will. The legal term for this is "ademption" and the bequest in the will is considered "adeemed." Thus, if the will said "I leave my VIN # Year/Make?model Truck" to "brother-in-law" and your father did not own this specific truck any longer at the time of his death, then brother-in-law gets no truck. Whether brother-in-law gets anything else will depend on the other provisions in the will.

If the language in the will was vague and if your father happened to own a different make/model of truck, your brother-in-law may or may not get that, but I or any other attorney would need to see the specific will as well as know what assets your father owned at the time of his death to know for sure. However, the brother-in-law does not receive the truck that is now in your name aand which was sold to you before your father's death.

He payed $400 total in payments and returned the truck on March 20th and said that he could no longer afford it. He never put insurance on the vehicle or transferred the title into his name, therefore, we had no problems restoring our ownership. Now he claims that we have to pay him the $400 back that he had payed towards the pickup, but my husband and I feel that he is not entitled to his money back since it would have cost him more than what he had payed to rent a vehicle for that length of time, and the costs to fix the damage that he did to the pickup is more than that amount also. So I guess my question is, do we have to pay this money back to him?

You will have to sue them, because Wal-Mart is very difficult about settling these kinds of cases, and from what I hear, you may have some trouble proving your case. Definitely sue them in small claims because it's faster, cheaper, and Wal-Mart won't be allowed to use a lawyer against you.

At trial, you will have to prove "NOTICE." This means, you have to prove that Wal-Mart knew or should have known about the spill, but failed to clean it up or put out a warning cone. In other words, you have to prove that they were "on notice" of the slip hazard.

This can be very hard to prove. If your witnesses only saw you fall, that doesn't prove NOTICE. It only proves that you fell. It says nothing about when the spill was created, and nothing about whether or not Wal-Mart knew about it.

To qualify for workers compensation payments, the injury must occur BOTH "out of AND in the course of employment" and while your injury seems to have occurred "in the course of employment", you may not have sufficiently demonstrated that the injury was a risk associated with your work activities, i.e., you may not have demonstrated that the injury arose "out of" the course of employmen; and/or, Workers Compensation payments may have been denied on the rationale that your injury was aggravation of a a pre-exiesting condition which was not work-related.

As to the "correctness" of the decision to deny you workers compensation payments, that is not necessarily an open and shut question with a "yer or no" answer. Perhaps if your type of case case had been presented and argued differently, the decision might have been rendered in your favor.

Usually, family members are excluded if not listed on the policy. Is the insurance company declining to pay because the boyfriend is excluded from the policy or because they don't think he is responsible for causing the collision?

Thankyou for your inquiry. Shared payment of the utilities/water/internet has nothing to do with the ownership of the home itself. Generally speaking, the house itself remains your sole and separate property after marriage (unless you add your spouse to the deed); however, the use of "community" income could mean that your spouse might have a claim to some kind of reimbursement or share of the house in the event of the divorce. There is not a black-and-white answer to this question unless you and your spouse decide to execute a prenuptial agreement to address your understanding (e.g. specifying whether there WILL or WILL NOT be some type of reimbursement/etc. in the event of a divorce). I recommend that you speak with an attorney as soon as possible to discuss this issue in greater detail and determine whether a prenup is appropriate or whether you are comfortable with an understanding of what the outcome is likely to be without a prenup.

Please Note I am not a mechanic. I had the same problem and found this answer:Tools and materials required:
Socket wrenches, 9/16th box wrench, torque wrench capable of measuring 10 foot pounds, Loctite for threads, Vaseline Petrolem Jelly, and of course a water pump replacement kit that includes the impeller, plastic housing, stainless steel back plate, two gaskets, and new bolts.Warning: The water pump is below the water line and when the lines to the pump are removed water will pour into the boat. I had my boat out of the water when I changed the impeller.Procedure: Loosen the idler pulley and remove the drive belt. Make note of the way the belt wraps around the various pulleys. Remove the two 9/16th bolts that hold the pump and bracket to the engine. You will now have enough room by pulling the pump out of the front of the engine to get to the two hose clamps on the water hoses. Mark the two hoses so you get them installed correctly. Loosen the two hose clamps and pull the hoses off the pump.I took the pump to my garage so I had access to a vise and wire brush. The wire brush was helpful in cleaning the bolt threads to make it easier to remove them. Mark or make note of proper position of the bracket on the pump. Remove the three nuts holding the bracket to the pump. Remove the 5 bolts holding the plastic pump to the metal end. Lightly coat the inside of the pump housing and the new impeller with the Vaseline. The Vaseline protects the new impeller as it will run dry for a few seconds when first starting the engine. Install the impeller in the new pump housing. Install the smaller gasket around the pump shaft, and install the new wear plate. Install the new gasket on the plastic pump, and then the plastic pump to the front half of the pump. Coat the new bolt threads with Loctite. Install the two shorter bolts and just snug them down. Install the mounting bracket to the pump. Hold the heads of the bolts when tightening the nuts on the mounting bracket.Reverse the order of installing the pump back onto the motor. Install the drive belt and set the tension with the idler pulley. Make note in your maintenance log of the date and number of hours on the motor when you changed the impeller. Total time involved was about 2 hours. This is a maintenance that can be handled by most weekend wrench-turners.

Yes, if you are "joint" on the account versus just an authorized check signer. It's called a garnishment, which is a form of collection activities performed by a judgment creditor. Once you receive notice of the garnishment (which comes after your bank has received the garnishment and has frozen the money), you have the right to object and have a hearing in court wherein you would have to prove that only X amount of the money in the bank account was yours, and that X amount belonged to the other person, and, therefore, your creditor is only entitled to the amount that was yours. Proving this can be difficult depending on how much money is in the account, the source of the deposits (paychecks and SS is easily identified, but cash deposits are almost impossible to prove ownership), etc.

It's also a hassle to be in this situation because you have to file objections (within a certain time period) and wait for a court hearing and, in the meantime, all of the money is frozen until the court decides who the money belongs to and how much the creditor is permitted to garnish/seize. It's best not to have a joint account when either person has a judgment against him or her, primarily for this reason. You would also need the joint account holder to come to court with you so he/she could testify and/or confirm that all or a portion of the money was his/hers, testify to facts and evidence to support that statement, etc.

Here's an example: a grandmother has a bank account for her monthly SS check deposits, which is the only source of her income. Her son is on her bank account to assist her with writing checks or in an emergency. He never puts money into the account or uses her money for his personal reasons. Son's creditor finds the bank account and garnishes some money. Son could easily show that based on the account history, every month for the past few years, the only deposits into the account are the monthly SS checks belonging to his grandmother and that he is only on the account to help her occasionally or for emergencies. That would be pretty straightforward and easy to demonstrate. However, most situations are more complex or convoluted so, again, err on the side of caution and try to avoid that situation.

Any codicil (an amendment to a Will) should be done with proper formalities concerning signing, witnessing and notaries. If your Will is typed, then you shouldn't do a handwritten codicil. Additionally, it is easier to do a new Will. This is because the original Will and all codicils must be read to determine your wishes. With a new Will, only that document need be read.

One more thought, you may wish to create a separate Statement of Guardian(s) and have that match whatever you are doing for guardians in your Will. The Statement of Guardian(s) can than be used if necessary if you are out of town. Remember that your Will is only helpful if you are dead. The Will has no validity during your lifetime.

Your statement of facts above is a little bit confusing. Was your daughter an H-4 or a TD prior to applying for change of status? She can certainly withdraw her F-1 change of status but she should apply for and secure the TD first prior to submitting her withdrawal request.

Under the Fair Debt Collection Practices Act, you have 30 days from the receipt of the debt collection attempt to request verification of the debt and disclosure of the original creditor's name. Further, if this phone call was the initial contact with the debt collector, they must follow up with a letter in 5 days giving you certain notices about them and about your rights.

You should send the collector a letter indicating that you want to see verification of the debt and disclosure of the name of the original debt collector together with any other information that they are required to disclosed under the FDCPA. Once you write that letter to them, sign it, photocopy it, and send it to them certified mail, return receipt requested and keep a photo copy of it.

If they don't follow through (and often these guys won't) then you may have a case against them under the FDCPA.

Understand that your husband could get a ticket, but still not be "at fault" in the accident. Fault is a civil court concept, while the ticket is for traffic court. Fact that she shouldn't be on the roads might be something for the judge to know, but it will matter little in the outcome. Another misconception is that there are cameras at every intersection, and thankfully, this is not 1984, but even if there were a camera at the intersection, most do not record. You would need to contact the city or county to find out for sure. A lawyer is going to be very helpful. They can properly cross examine lay witnesses, who, unlike police officers, do not testify regularly so they can be exposed for weaknesses in their case. Furthermore, judges prefer to see clients with attorneys so that the process is more focused. You need to contact an attorney in your area. Prices will vary by location and the attorney themselves, so call a couple to find out.

Sure, go to your local magistrates office and swear out a warrant for assault. Sometimes magistrates will try and 'talk' you out of having a warrant issued or they may flatly refuse to issue a warrant. If this happens you may need to firmly remind the magistrate that he is obligated to issue a warrant if someone is making a legitimate allegation that a crime was committed.
