In July 2010, I purchased a vehicle for use by a then boyfriend with a verbal agreement that he would pay me back. I did register the vehicle in my name and carry its insurance under my name.

On September 15th, 2010, he left me and took the vehicle saying he would pay me back in a letter (he moved to Ohio with it). I did not pursue criminal allegations because he said he'd pay me back (stupid on my part).

In March 2011 I began pursuing further getting payment on the vehicle and tried to get him to sign a promissory note with the vehicle as the guarantee. Trying to get him to sign a note has been going on until this past month. Now he states he is not going to pay me back and if I want the vehicle, I have to come to Ohio to get it.

The local police said this was a civil matter. But they didn't give me a lot of time to explain all the details either. I am looking into repossession, but that all seems like I have to have a loan document with the vehicle as collateral. This is my vehicle, in my name. What can I do?

Signing the birth certificate raises a presumption of paternity, but gives you no legal rights whatsoever. Since you and the mother were not married, you will need to file a petition in the Superior Court to Legitimate the child. As part of that process, you can be given joint legal and physical custody of the child. Since you and the mother are living together and getting along, now would be a good time to get this done, as she could oppose you, and possibly would, if you were not together. If it helps, you can tell her that one result of the legitimation would be that you would be able to take the child if something ever happened to her. With her on board, the process is relatively straight-forward. We have a Jefferson office, and would be glad to meet with you to discuss this at your convenience.

You need to take the form you signed to a family law attorney. Simply signing an acknowledgment of paternity does not legitimate the child. There is a legitimation form which may legitimate the child, although some attorneys believe you still need to file to legitimate. You need to file a contempt action and bring him back into court. If you are sure that he is making money o the side, ask for his financial records - ie Tax Returns. If you know where he is working on his second job you can subpoena the income records from them.

JTWROS as I've read it, means that the other brother would receive the remaining 50% of the property; however, within a Community State such as California, would this change?

The probable result is a trasnfer to the surviving brother. This type of issue, however, is what makes lawyers wealthy. Why not prepare documents specifically addressing the problem and avoid leaving it for parties to dispute after a death occurs. Why not find out what the intention is. Is it to go to the brother or to the wife? Once you determine this, estate planning documents should be prepared to assure that result.

Be aware that there are income tax, estate tax and property tax issues to consider as well.

It would be a second offense but only if the DA finds out about it. It would depend on whether DUI in MA was a misdemeanor or traffic offense. If it was a misdemeanor and you were fingerprinted then the DA would find it when they run your criminal history. Also, if it is on your PA driving record they can find out about it.

If it is not on any governmental record they they likely would only know about it if you told them.

They consequences are vastly different - a conviction for a 2nd carries with it mandatory jail time - anywhere from 5 days to 90 days minimum. If they do not find out, they may offer you ARD where the case gets dismissed after classes and fines.

The landlord first did you a favor by signing for the package, but opening it was not legal if it was addressed to you. If it was delivered by US mail service, this is a federal offense. Unless the lease gave you the right to move out on 30 days' notice, you may have had no right to terminate solely because of the landlord's conduct in opening the package. More information would be required to determine whether you have any right of recovery and this would involve a visit with an attorney.

No, without seeing a complaint. No lawyer is going to handle this on such short notice and without you paying. I don't quite understand - if you are already paying, then why are you being sued by the lawyer? Do you have any defenses? Objections? Who is suing? For what? Do you owe the debt?

Generally, an answer (assuming that is what you are talking about) follows the format in the complaint. Look at the complaint - copy the caption (creditor, plaintiff v. you, defendant). Where they have the word complaint, you put the word answer. Copy the same file number.

Turning the heat on would actually lower the engine temperature. It's a well known trick if your car starts to overheat. Having the A/C on causes a power loss to operate the compressor, which would also cause engine temperature to go up due to the hot air from the condensor going through the radiator.

Its a little hard to explain, but here goes. You fill in your gross income, net income, and deductions in the Guidelines Worksheet. After that, you can deduct the child support you are paying on the other child as payments for qualified children. You use that adjusted figure for the chart calculations and get that new amount. You may need to prove the other obligation and that you are in fact paying on other obligation. I can answer more questions if you have them.

In contacting the mortgage company to follow through, they are requesting a letter of administration. Which through my research I'm not sure if I would actually need.

There are a few issues in your equestion. First if you were designated as the beneficiary to recieve your Mother's home, and it had a mortgage on it, you would not necessarily have the right to assume her mortgage. In most cases, you are required to pay off the mortgage, either by 1) selling the property or 2) obtaining a new loan in your name that pays off her loan. This is because your Mother's income was the basis for the old loan and unless you were on the mortgage or the note, you would have to apply under your own credit to recieve the mortgage. The mortgage company will most likely not talk to anyone, except 1) the Court Ordered Personal Represenative, (or the executor of her estate), or 2) the person that was designated and approved in the Letter of Administration, as the beneficiary of the real property, so, yes you will probably have to supple that document. I would suggest that you see out the assistance of an attorney to get your real property issues resolved. When someone inherits a home, they inherit it contingent to the debt against it. Good Luck.

Assuming the house was just in your mother's name, it will be necessary to get a court order to transfer it into your name. Wills do not avoid probate, they speak in probate, directing the court on what is to happen. So the court has to issue an order to resolve the ownership.

As to the mortgage, you are not required to assume the mortgage, nor pay it off. You may continue to pay on the mortgage until paid off. I would not recommend you to assume it since you are not presently liable, and you are not required to become liable on it.

You may have to provide the Letters to the bank so they will converse with you on the matter and be able to take the tax deduction on interest paid. But be careful on anything you sign so you don't assume the liability.

It is not necessary to assume the mortgage since you would then become liable for it. You can continue to make the payments as they are. Refinancing is expensive - it would entail new rate not to mention all the other added fees, ie credit report, appraisal, bank charges etc. The court will give you the property and give you the homestead exemption. The contractual terms (all their terms) were that they will deposit money into the account by the 20th. It does not say around the 20th, but on or before the 20th, however, usually the 20th is what they stressed. The 20th rolled around, and no money was deposited. I contacted the agent I'm working with who claimed they were reverting to an older system so that they were having problems with the accounting. I asked when she predicted that things would be fixed and when they would deposit the money. She patronizingly said that she already told me they were having problems and that she would call me this past Monday (I spoke to her on a Friday). Monday rolled around, and I did not get a phone call. I gave her the rest of this week to see if she would attempt communication, but she has not made an effort.

That was not the first time that she has failed to communicate. I sent her some utility information that I wanted her to address early on in the month and did not hear from her till pretty much the 3rd week of the month to which she did not give me any updates, just a, "thank you". I am not a monster client, I have e-mailed this woman 3 times and called her twice so far, and it has been very difficult to have any kind of communication with her.

I understand that companies/people run into problems sometimes. I'm even willing to let this month slide if this is a one time thing, but there is something nagging me inside that all future business will be handled in the same manner. For one, I have yet to receive any money in my account, but they have taken their fees. I didn't know that their accounting/computing system was limited only to providing clients with their funds (she told me that they were running problems with everyone's accounts so she can't just focus on my account).

I guess that lengthy back story was to see if they breached the contract first, and if so, can I get out of it and claim back all fees that they have taken? This is a one year contract and only the first month, but it has been a very unprofessional month. I guess I'm just looking for some legal advice as to what my rights are and what my actions should be. Any help would be greatly appreciated.

Of course everything I state must be prefaced with the fact that it is absolutely impossible to give an accurate or even appropriate answer to a contract question without actually seeing the contract. However, since I have seen these property management contracts before let me state a few things.

1. As a contract for services the common law governs the legal issues of the contract as supplemented by Washington state law (judicial and legislative) on the subject.

2. The Consumer Protection Act of Washington is "in play" although not greatly.

3. The contract has most likely been breached by the failure to adhere to the specific promises of the contract (which terms, specifically, I can only assume relate to the time of payment, a "best efforts" or "good faith" provision may be breached as well, and other terms of which are unknown.

4. The degree of the breach is what is at issue primarily: is it a minor breach where you may only recover damages, or a major breach where you may recover damages and rescind the contract.

I know that doesn't help much, but without seeing the contract it really is difficult to do anything other than make statements that are greatly vague or hedged.

The owner doesn't need to give you any reason if you are month to month and not in a rent controlled jurisdiction, so whether it is OMI or any other reason doesn't matter. What does matter is that they must give you 60-days, not 30, since you have lived there more than a year. Your best bet is to object to the notice and tell them that it is invalid. Then negotiate a cash for keys deal on a time frame that is favorable to them but viable for you.

I assume you mean a guardian ad litem. You could ask the court to appoint an attorney to represent your stepdaughter but you would have to pay that attorney's fees. You could also ask the court to refer the matter to social services for a home study and you will have to postpone the upcoming hearing for that to be done. If that happens they will conduct a study of the 2 homes and advise the court where the child will be best served for custody purposes.

the house sat empty for a couple of years before I bought it, and they never had the tree trimmed during that time (even just on their side of their property, as they are entitled to).

The first couple of days after moving in, the neighbors were at my front door yelling that I trim or cut down my tree (that was how they introduced themselves), and they have been similarly nasty about the subject since. They're certain that the tree is the cause of regular ant infestations in their house. There are ants everywhere in this neighborhood, including occasional infestations into my own house, even though I don't have any trees touching my property, so I'm dubious of their logic.

In the past, I've acquiesced -- I was interested in getting the tree trimmed to provide more light for my backyard, and then once again after to keep the peace with the neighbor. Since the tree is huge, the cost to have it trimmed is not trivial.

They've never expressed gratitude or been neighborly in any way -- they've actually been nothing but nasty about this and other issues (a shared fenced that they refuse to contribute to, etc.).

Given their attitude, I'm less and less inclined to keep paying to keep the tree trimmed, but it's not clear to me if I'm responsible. I'm curious to know if I'm legally required to pay to trim the tree, or if I can just tell them that all I'm willing to do is to give them permission to have the tree trimmed themselves, on their side of the property line.

I've poked around the internet, but could not find an answer.

I was also told at that time that I owed $95. so I had to post a $95. bail for that to be released . I thought that would end it, however I just received a notice from that court of a court date?? I do not live in that area anymore and do not have any way to go there. again this is a 26 yr old ticket which I do not remember. what do I do ??

This type if issue will require a Court appearance. However, since you are out of state, if you have an attorney represent you typically you would be allowed to proceed through an affidavit without appearing.

The $95.00 was the bail requirement that was probably set by the Court because you never dealt with ticket. By paying that money this lifts the warrant and can allow the Court to reschedule your case. It is unfortunate that you cannot appear there because before rushing to have an attorney plead you guilty by affidavit to a 25 year old ticket it would pay to find out if the officer who wrote the ticket is even still employed with the department or available. It would first pay to find that out because if they cannot produce the officer then the state cannot prove the case and you may be able to get the ticket dismissed. The court may assess a contempt of Court fine for your failure to appear but this is a crucial issue that needs to be addressed before you run to plead out a ticket that the prosecutor cannot prove. So this past Friday, my friends and I got pulled over for the tint being too dark on his vehicle. Long story short, the driver said it was fine to search the car. The police (who was a narcotics officer) found a small vacuum sealing container that smelt like and contained a couple tiny (really tiny) crumbs of marijuana. This is the second time I have received a notice to appear for possession of drug paraphernalia. The first time (about a year ago) I was put on probation, had to take a class, and pay some fees (completed everything in about about a week and was off probation) but I did a background check of myself on the state website and it pulled up no record of me. So I guess my question is what can I be expecting in court?

Another note I should add. The officer pulled me aside and told me that if I work with them to bust a dealer of mine (my identity being kept confidential), the charges would be dropped, however, this could potentially put me in a sticky situation.

Any advice would be greatly appreciated...

Do not, under any circumstance, work for the cop. He is lying to you about the charge being dropped and he is putting you in danger. Unless the MJ was found on you personally, they very likely cannot convict you of the crime. See an attorney and get some good advice.

In the case of minors on title to real property, it's much easier to give than to take away.

It is a mistake to think that minors are no allowed to own property, especially real property. A minor is perfectly capable, for instance, of receiving real property as a gift, i.e., by inheritance. Parents have certain custodial and managerial rights, especially to a minor's earnings, but minors are not without rights as well. See, e.g., Family Code sections 7500, 7502 and 7507

However, minors selling real property is another matter. Minors cannot make a contract relating to real property or any interest therein. Family Code section 6701(b).

There are the following possibilities: (1) wait for them to attain age 18. (2) via a petition for emancipation, the child may be granted adult status by a court. (3) although I could not find the applicable statute (probably in the Family Code), I'm sure there is an often-used procedure for petitioning a court for an order authorizing the sale of a minor's interest in real property. The court would want all the details including why the proposed transaction was in the minor's best interest and what would be done to protect the minor's interest in the proceeds of sale, perhaps requiring that the minor's share of the proceeds be put in a bank account in the minor's name, not to be touched until the minor reaches maturity, or 21.

I tried to file a request for trial postponement in small claims court in California (I am the defendant). Because of a misunderstanding on my part it was not filed and returned to me because I did not include $10 filing fee. I received that notification on Thursday July 26, and the trial is Monday July 30th, therefore no time to postpone it, and, I currently live out of the country. I spoke to clerks at the court house and was told about filing a motion to vacate after judge's decision. Also spoke to small claims adviser and was told it was worth resubmitting it even though there was no time to postpone. I hired a courier and they did the filing for me on Friday the 27th. I explained that I had tried to file before, and that the reason I could not be there on trial date is because I live out of the country, have a son whom is a minor solely under my care that will begin school next week, I have no one to care for him, and also the travel expenses I would have to incur. I did this in the hope that the judge will have this information at trial and at least see the reasons why I am not there, and that I did try to postpone and do things right. What is your opinion on this? Would my attempt to reach the court may be of any benefit to me? Thank you.

You cannot be sued in the small claims court if you live out of state and especially if you live out of the country. But if you lived in the state when you were served with the complaint, then being out of the country now is only an issue relating to good grounds for continuing the trial. Good Luck.
