My son was hit over the head while standing in the doorway of a local bar and he did not see who did it. He required several stitches to his head inside and out and had to get a cat scan. It was completely unprovoked and he was knocked out. When he came to he had blood all over him and no one called an ambulance or the police to help him. He was dazed and finally became aware enough to call a friend to come and get him and take him to the hospital. The bar has video tapes and are not being very cooperative. The police think it may have been an employee. Do we have a lawsuit against the bar if this happened inside whether we cant find out specifically who did it??

You might have a law suit against the bar, but you really need more information. In order to sue the bar, you need to be able to prove that they did something wrong, or didn't do something that they should have. There must be a basis for the law suit.

Your question said the bar has not been very cooperative. I assume that means they would not let you see the video. But you never said. Nor did you say if the police watched it or got a copy of it. It sounds like that video might be crucial.

You really need to some how figure out as much as you can about what happened. Without more information, you really don't have much to back up a law suit. Law suits must be proven, not merely alleged.

I made 2-3 payments of $300 to the credit card company and the last payment I did was a day late. They never applied those payments to my account and reason i stopped paying. It depends on what is in the re-payment agreement and what constitutes breech. If strict construction of the agreement defense late payment as a breech of the agreement, then you are in default. In that you made a late payment, if they did not accept payment and returned to you then the pay properly sue you for default. Ultimately, their goal is to collect what you owe them. It is possible that legal counsel may be able to negotiate a settlement on your obligation. More importantly, if overall you are having financial difficulties and are behind in a number of your obligations, it may be in your best interest to talk to a bankruptcy attorney. In theory, it is possible that bankruptcy cold stop all collection activities cold that may be proceeding against you and it may give you breathing room to restructure and reduce your debt to a more manageable level.

He was suspended from the following game as well. Now the league is saying he is suspended for 2 more weeks pending further investigation. He has had a meeting with the little league board and has apologized to his coaches and some teammates. I have apologized for his behavior to all the parents on the team. If he is suspended for 2 more weeks he will miss practices and 4 more games. That is a total of 5 games missed. The season only has 10 more games left. It feels as though he is being bullied into quitting and I am being ostracized as well. I know for sure that 1 parent said if he returns she is pulling her son out, but he made a mistake and has been punished for it. I am not sleeping well and do not need the stress but have always told my son not to quit. This is my son's last year in little league due to his age and he has been in this league for 10 years now. The bullying and ostracizing is the part that is making me sick. Is there a possible civil case so this does not happen to another child?

You probably need to review the league rules to determine if this level of discipline is appropriate.

It appears that your son, who should know better after 10 years of playing, is a poor sport. Your reaction seems to me to be a little over the top. It might be better for your health if you don't get so involved.

Unless there is some departure from the league rules, which I doubt, I don't think there is any valid civil suit here. I don't see that the rights of your son or you have been in anyway violated. Perhaps instead of looking to sue, you and your son would benefit from counseling and anger management classes.

A boy who gets ejected from a game and then throws a tantrum over it needs 1) to learn a lesson. 2) a counselor WAY more than a lawyer, and 3) parents who realize that getting him out of the penalties for his misconduct is damaging their son's character. Does it not occur to you that YOU being ostracized is because YOUR response to this situation is a problem as well? Do you not realize that the other parents see your son's parents as the root of the problem if they are treating you this way. Does it not occur to you that they may well be right? The law is not going to help you prevent your son from suffering the consequences of his misconduct. Boys who don't face their consequences and learn proper impulse control and good conduct are the ones who become legal problems as young men - on the criminal law side.

I hold him on a leash when he jumped out of van. Unfortunately, a man was walking by and when our dog jumped out, the man started hitting him with newspaper in the face. Therefore, I called 911. When police arrived, man was asking for money. He said that he needs to go to hospital, but he doesn't have money and pointed to me that I do. Then police called ambulance and man was taken to the hospital. I do have a copy of the police report. The police report says that dog was on a leash, that man hit dog with newspaper, that man asked for money and that man has small puncture wound on his tight. I am not sure where this wound came from, but police made picture of a very tiny puncture. Please note that we have big dog and if this kind of dog bites it will not be small puncture. The reason for contacting you is because we received letter from man's attorney asking to provide liability insurance information. The letter states that incident is "Unprovoked dog bite". This is not true (police report supports it) and I believe that I probably have more rights to sue the man for abusing our dog and standing naked in front of our house, then he does to sue me. It appears that man was waiting for us to provoke dog in order to gain money. I am not sure what to do. Your help and advice are greatly appreciated.

I would complain to my boss on a daily basis, and my boss would say that not your job you cant clean that up, but at the same time expected me to show up and still work. This went on for a few months. then I went to my clients family and explained to them under the agnecy rules I am not allowed to clean up the clients feces. And by the client living by himself the no one else was there to clean it. So I always ended up cleaning up the mess. So I took there offer. Now my old boss is saying i stole his client and he is taking me to court. I never signed anything stating I wouldnt be hired a a private caregiver. Plus my old boss agency could not meet the needs of the clients because of their limitations. My question is what can I do, and can he take me to court?

He CAN take you to court, but that doesn't mean you did anything wrong or that your boss will prevail. He is trying to enforce what is called a "covenant not to compete" except that you are under no such covenant. However, you do need to defend yourself.

DON'T DO IT! Whether you would be guilty of malicious mischief is questionable but you would be in contempt of court for violating the orders that are on the back of the family law summons. Went for my citizenship interview today. Everything went well with the exam until the last part when the examiner said that there are information that were not included on my application for an arrest with no charges filed that happened in 1991. I told her the truth that I did not know that the information was left out of the N400 application by the person that prepared the form for me. She told me that she will not be approving the application at that moment until she does more investigation into the matter. She said I should be hearing from them in 30-45 days.

I will like to know if there anything I can do to resolve this situation. Do I need to send them the paperwork for the arrest and write a letter to plead my case?

Desperately need help.

Yes, you should have reported all arrests and convictions as the N-400 clearly asks for that information. At this point you should submit the arrest report and explain what happened. I strongly urge you to retain an attorney to help you with this as you could also be accused of misrepresentation since you did not report the arrest when filing the application. My ex wife has recently filed a warrant for back child support but i have been making payments I still owe for back child support but i have been paying what i owe, i had switched jobs and missed about month but havnt missed since than, she has now told me tryed to drop the warrant but the judge will not let her asnd told her i had to sit in jail. If all you missed was one payment, then just pay it. The best way to avoid trouble is pay off the arrearage (including interest) prior to trial date. If I were you, I would borrow money from any source that I could (family, friends, 401(K), credit cards) and sell any items I could to raise the money and just pay it off. If you have done absolutely everything possible to pay it off, you are not going to be found in contempt and sent to jail. But you must do EVERYTHING and be able to show the court all that you did.

My boyfriend and I have a beautiful 6 month old daughter. We have NEVER been married and we have Never been to court for a custody hearing (which I was told gives me full custody of her.) I have never kept him from seeing his daughter and I allow him to come and visit whenever he like. He doesn't pay child support but do what he can for her when he can. My question is do I have to let him remove her from my home for a visit when he wants to see her? About 2 months ago she started this screaming thing whenever she is in his company too long. I placed a stop payment the next day as soon as the bank opened because the painter did not come to finish the work or deliver the supplies. I tried calling him and there was no answer.Later the # was disconnected. On the same day I placed a stop payment a check cashing place cshed his check. My bank did not honor the check because of stop payment.The check cashing place did not call me to verify the check was ok to cash as they did a week prior when I wrote a prior check to the painter. In the mean time I had no idea the check was cashed by a check cashing place because I had moved the house is vacant for sale. Now the check cashing place is suing me in GA civil court it was just filed. I found out through advertisiments being forwarded to me. Am I legally liable. I have not been served.

I answered this question already, but now you have added new facts and now indicate that you have been sued. You are going to need a Georgia litigation attorney, one that handles consumer debts.

As I indicated, it appears that the check cashing place was a holder in due course. What that means is they took the check, for value (they cashed it), in good faith and without notice. If that is correct, then they can enforce it. As between you and the painter, you need to go after the painter.

Getting back to the check cashing place - this is a slim chance - you indicate that they called you once when you wrote the check to the painter? Is there anything that would suggest that they knew something that this was not a good situation? If you can show that they had notice or had a reason to lack good faith, then they would not be a holder in due course and you would be able to raise the issues about the painter not doing the job.

However, you can't do anything until you talk this over with a lawyer. You have 30 days to answer the complaint. I would get a lawyer to draft a proper answer for you and see if something cannot be worked out. I would also seek to drag in the painter into this lawsuit as he is the one who got the money and who should be liable to the check cashing place, not you.

Hello. In the vast majority of cases, the DFEH concludes that they didn't really find anything and they issue a right to sue letter, which is a pre-requisite to filing a lawsuit for FEHA violations against an employer. The conclusions of DFEH don't really say anything about the merits of the case. Of course, if DFEH indeed dismisses the case you are well advised to contact an employment attorney to discuss the merits of your case. The right to sue letter also may be obtained at any time online by an attorney by simply filling out an electronic form. This shortcuts the whole DFEH process.

If the DFEH issues finding, they might want to prosecute the case, issue fines and penalties against the employer and award compensation to you. This happens very rarely however.
