The proper paperwork to transfer the property would be a quitclaim deed. However, with a situation like this, it may be necessary to discuss with an Attorney as to how best to move forward. I would be happy to discuss with you in my office should you like.

My best guess is that the farm is still titled in the name of your deceased parents. If so, it may be impossible to transfer title either of the farm or of the land contract vendor's interest without a probate court order. That will require someone to probate the estate, since the will alone has no legal effect until a court orders its provisions to be carried out. However, if the farm was instead in a living trust (a very popular estate planning tool these days), a probate court proceeding may not be required. If you or any of your fellow sibling heirs also die without proper estate planning prior to their death, the same thing will probably be true--a probate lawsuit will be required in order to remove their interest from the title or sell their interest. Probate proceedings can become very expensive and that is the reason why many people instead retitle their land in the name of a family trust these days. Then, the death of one trustee automatically causes the successor trustee to take over control of the land without any court involvement. Even though setting up the trusts can cost several thousand dollars, it is far cheaper than a probate court proceeding which can cost tens of thousands of dollars and take years to complete. I recommend you check with your employer before you have an autistic adult entrusted to your care arrested for behavior that is consistent with being an autistic adult as it would likely result in a lawsuit against both you (individually) and the program. It is likely that your employer has very strict rules for the use of force against disabled adults in its care (it should have these), and also has very strict rules about patient behavior that could result in this autistic person being ejected from the program.

She can not move without her ex's approval or an order of court. Illinois does not permit a divorced custodial parent to leave the state (remove) without either of the above. She must petition the court for permission to leave - and the burden is on you and your wife to show the court my the removal is in the best interest of the minor children. It is not a simple issue. It also may depend on where you live in this state. Different areas may have different standards.

You will need your own ex parte to have trial date motion heard sooner. Depending on County, discovery motion and trial date may not be before the same judge. Since the other side won't stipulate to a continuance, you need to move quickly to get a continuance. Your attorney will want to explain in response to the discovery motion that he is new to the case and if you were unrepresented when you failed to show for deposition (or whatever other extenuating circumstances exist). Since you now have an attorney, you should direct your questions to her rather than to us.

The other side's motion to compel your attendance at a deposition and their request for sanctions sound appropriate to me. Your outrage at "this legal assault" is misplaced, since the other side is acting quite properly. You were obliged to attend but didn't, and the other parties spent money for their lawyers and court reporter to be there. Parties who plan not to appear for a properly-noticed deposition should at least notify all the other parties (through their respective lawyers) of their plans ahead of time. Those who don't give such notice are responsible for paying all of the fees and costs the other parties incurred as a result, including those incurred in bringing the motion to compel. Even parties who do give such notice before missing their depositions are properly subject to a motion to compel and will usually be ordered to reimburse the fees and costs associated with the motion, though they won't have to pay for the additional costs of the depo they didn't attend.

In addition to monetary sanctions, your opponents can seek evidentiary or even terminating sanctions. Evidentiary sanctions are orders forbidding you to present certain evidence and directing jurors to resolve certain issues against you. Terminating sanctions are orders dismissing your pleadings and putting an end to your role in the case. If you are the plaintiff, that means you lose. If you are the defendant than the plaintiff will still have to prove his case, but you will not be allowed to contest it. Given how close you were to trial when you missed your deposition, the other side may very well be able to get such sanctions if their motion asks for them.

We purchased a property in October of 2012 with the understanding that a garage would be built. before our initial closing date, the seller toldus that she was having issues securing a permit to do so because of the language of the easement agreement that was written up in the 70s. The city asked the seller to have the language clarified with our neighbor whose land the easement was on. The seller did so and submitted the document to the city recorder, the permit was secured, and the garage went forward. Fast forward, after closing, the garage is finished and we find out we can't use it, because of our neighbor's shed is in the way (on our land- the turning radius is too sharp for us to get into our garage). We talk to the neighbor, ask if we can move his shed over ten feet so we can use our garage, and he tells us no because he has rights to our land in that spot in case he wants to build a garage in the future! Long story short, we find out the seller amended the agreement 4 days before closing to include this! We never were notified of this, although our title company apparently was, as I just found out.

The secretary of state controls when you are suspended. You should order a copy of your driving record from the Secretary of State and heave an attorney review it with you. A conviction for OWI enters when you plead, not when you are sentenced, and when you plead to OWI the court informs the SOS of this electronically. At that point the SOS issues the suspension and mails out notice to your last known address. The DWLS act would not be a probation violation because you had not been on probation yet, but it could have been a bond violation depending on what do's/don't's were listed on your bond. Also, the judge sentencing you for the OWI can factor in your DWLS behavior when fashioning an appropriate sentence.

Why don't you send her a real letter instead of email and text messages? Emails and text messages do not count and she may or may not have received them.

If you don't know her current address, get it. Write her a letter and send it certified, return receipt requested, or via FedEx/UPS with signature confirmation so you know that she actually gets it. Keep a copy for you and make sure its dated.

Give her 10 days in the letter to come and get her stuff. If she does not make suitable arrangements within this period, tell her that her stuff will be disposed of.

Take an inventory of each of her possessions and value each item even if you think its junk. Take a picture of each item too. If you do not hear from her in 14 days, then take her stuff to Good Will or the Salvation Army. They will usually hold her stuff for 30 days. If she contacts you after 14 days but after you have taken her stuff there, you can tell her where it is at. After that time it will be disposed of.

She has 2 years to sue you for conversion of her property so that is why it is important for you to take a detailed inventory and get a valuation and send the written letter and keep a copy of it. You want to protect yourself from any claims by her that you disposed of her stuff without her knowledge and you want to protect against any claims by her that she had a really valuable item there.

If her items are valuable or over $500, then you may need to get more specific appraisals (i.e, a coin collector would appraise a coin collection, an antique appraiser would appraise an antique and so on).

Also, many times I will leave my home at 6am and not get home until 6-6:30pm and will have never received a lunch break or any other breaks. When I have questioned my employers about not getting a lunch I was told to "take something to snack on between seeing patients." At my main office we get a 30min lunch break and a 15 minute break....when I turn in that I didn't get a lunch they only pay me for 30 minutes.

It really has to do with your terms of employment including but not limited to whether you are an exempt or non-exempt employee. If you are exempt you are effectively on salary and the rules are different. Non-exempt (primarily hourly wage earners) have overtime...protection. And PTO varies. HOWEVER: generally an employer can not force you to use PTO if THEY control the hours of operation and shut down early. Based on some of the responses you've been given it sounds like you are being treated as an exempt employee. You may need to sit down with an attorney and go over your total job situation to get a handle on this.

All of your questions should only be answered by a lawyer who has reviewed all of the documents and facts. You refer to several documents (and there will be others) that no one here has read. Thus, you can't get a meaningful response. One thing we can agree on, undertaking this without a lawyer would be a horrible and ultimately expensive mistake. In addition, trying to force a sale, even if done correctly and with a lawyer, would be very expensive. Your letters are useless. Property owners don't lose their interest because a co-owner sends a letter.

You don't get people on or off a title by sending mail. What you probably do at that point is get them to ignore you, because they would know that yoiu do not have a lawyer and have no clue what to do. The letter was a poor move that likely will complicate doing things right.

Your rights depend, in an inheritance, on both the will, and on paperwork done in probate. To the extent you have rights under either or both, you would need to retain a lawyer for what would be a very complex and usually expensive case. It may involve some work both in probate court to force proper administration of a case, and a partition action in superior court, which, in a bad real estate market, is a great way to make sure that everyone gets far less than the real value of the property (even in a good market, it's a tough thing).

Stop sending letters and see a lawyer to review the actual paperwork.

In a tax sale, the City sells your bill (actually becomes a lien against the house like a mortgage) to a bidder. The bidder who buys your bill/lien can sit back and let the interest accrue until payment occurs, or can eventually sue you to foreclose the lien. If the bill plus accrued interest is not paid when he sues, the house can go to a Sheriff's sale. This is how many speculators acquire property at a steep discount. If you have a mortgage this also has to be paid at a sale, so this could make the sale more difficult. I also add that the bid for your bill is for an interest rate, which could go as high as 18%, so buying your bill/lien can be a very good investment, unless your house has no or little equity.

Answer

Well you either get him to agree, or you file a specialized action called a "partition" case. In the olden days when joint owners of property couldn't cooperate, the courts literally partitioned the property creating new parcels. Under modern parcel map acts, zoning laws, etc., that is no longer possible, so the courts conduct what amounts to a combination foreclosure sale and partnership dissolution. The property is sold at a sheriff's auction and then the owners litigate over their share of the proceeds.

Considering that sheriffs' sales draw a fraction of the market value of properties, the filing of a partition action almost always results in either an agreed buy-out by one owner, or a joint agreement to sell the property for market value and then they litigate or settle over who gets how much of the proceeds.

I have handled a number of these cases in my 27 year career and would be happy to discuss how I might be of further assistance.

I will describe two legal principles that, if used together, could produce a very favorable result.

The first is that you probably can successfully claim 95% (more or less) of the ownership, based upon your 95% down-payment and a legal principle called "purchase-money resulting trust," where title can be shown equitably owned in proportion to where the purchase money came from, irrespective of how recorded title shows (tenants in common, joint tenants, etc.) down at the courthouse, including the percentage ownership shown on the record. A purchase-money resulting trust cannot be established against evidence that one party intended to make a gift of some of the ownership, but such a situation (a gift) usually is only found where the parties are parent and child or husband and wife, not brother and sister.

So, a lawsuit to quiet title, i.e., to have you awarded 95% ownership, would be part one of the proposed legal action. Part two would be a so-called "partition action," which is a highly specialized form of lawsuit used to divide ownership between unhappy co-owners of property. Originally, the court would divide the physical parcel (generally, a farm or ranch) between the squabbling heirs, hence the name "partition" -- but by the mid-20th Century, we were urbanized and had laws and policies restricting subdivision of parcels, so more and more the result of a "partition action" is a court-ordered sale of the co-owned property, then a court-ordered division of the net proceeds of sale (after paying taxes, loans and liens, and the costs of sale). The distribution of the net proceeds is done with due judicial consideration of not only percentage ownership, but also excess expenditures that one former owner may have made for mortgage payments, property taxes, insurance, and necessary repairs. Cost of improvements to the property might also be figured into the final accounting (if all co-owners had agreed upon and/or benefitted from them), as well as rental profits made and not shared.

I recently found out my dad died in Dec. 2012. I found out that he executed a deed in favor of my 1/2 sister 2 years before he died, but it wasn't filed until the day after he died. She never told me he died and won't respond to my phone calls. No will has been filed for probate and if there is a will, I don't have it or know its contents.

Can I bring an action seeking cancellation of the deed/inter vivos transfer for undue influence or lack of capacity (he had alcohol dementia)? Or do I need to petition the probate court for letters & sue in the name of the estate? Do I have standing to "protest" the conveyance, independent of probate court, b/c I am an heir?

You can do all of these things, and you need to find a probate attorney who is willing to pursue all of these avenues. While a signed legal document is presumed valid, proof that he was not competent could invalidate both the will and the deed. As his daughter, if there was no valid will, you are entitled to a share of his estate. There are also some technical issues with regards to the delivery, execution, and filing of the deed regarding the land which may make that a civil issue unrelated to the estate itself. Find a probate attorney asap.

I agree with Attorney Gardner. You do not indicate where your father lived at the time of his death, what he owned besides this piece of land or any other relevant details. Did your sister have a POA over your father? If so, when was it drafted? What was your father's mental state when he signed this deed? Who is the other owner of the property? Was there a right of survivorship on the deed?

The execution of the deed and the timing of the filing is kind of suspicious but a litigation attorney will have to review this.

What did your father own besides the land? What is the land worth? What are the other probate assets and what are they worth?

Litigation is very costly. You can file documents to compel production of a will or seek to become the personal representative of an estate if there is no will. However, wills or state intestacy laws only govern probate assets. If the land was a joint tenancy with a right of survivorship, that is a non-probate asset. If your sister engaged in undue influence or fraud, then you would have to bring an action against her to have the deed invalidated or to have a constructive trust imposed on the land. You would need a probate litigation attorney or real estate litigation attorney to handle that. The attorney should practice in the county/state where the land is located so/he she will be familiar with the courts. For probate or a will caveat, you will need a probate litigation attorney in the county where your father lived at the time of his death as that is where the estate will need probated Ideally, it would be great if the same attorney could handle both issues but probate/will caveat is a separate legal issue from the action against your sister on the land.

It also concerns me that you did not learn of your father's death until recently. Why? Were you estranged from the family? Obviously you were not in the loop here. I am not judging as I don't know the facts but it looks unseemly when a child has no contact with a parent and suddenly emerges after the parent's death looking for money. It comes as a surprise but there is no right of a child to inherit anything from a parent and the deceased parent, if he/she made a will may completely disinherit a child if the parent so chooses.

There are a whole bunch of family dynamics at work which will be helpful to know - for example did your sister have a power of attorney over your father? Did she provide for his care until he died? It is conceivable that he intentionally wanted her to have the property especially if she was caring for him. On the other hand, she may be greedy too and misused the power of attorney and the fact that she does not respond to your attempts at communication is not a good sign. However, if your father lived with her or in a nursing home then it is conceivable that he had no probate assets and that no will was probated because probate was wholly unnecessary.

So this gets back to your hiring a lawyer. You have to at least pay the lawyer for a consult to review the existing deeds. You need to find out what it is going to cost to either compel the production of a will or to apply for probate and administer the estate as well as bring a lawsuit over the land. You will also have to find out what assets exist for probate and whether at the end of the day it will be cost-effective for you to pursue litigation.

You have no right to force a private physician to retain you as a patient, so yes they can deny service. As far as changing the terms of a "payment agreement," you stated there was no agreement. The fact that you paid what you could (or wanted to) does not make an agreement (it takes two to "agree"). The staff could have let you know before you arrived, but that is a courtesy issue, not a legal issue.

Yes, unfortunately, its legal. Doctors are not banks and just because you were on the Easy Paymeny plan that does not mean that the doctor went along with it. I am surprised that it went on for as long as it did. Most health care providers are getting very aggressive and are now turning bills over for collection if unpaid for 30 days.

There is not much that you can do. The doctor may or may not know what his staff is up to. Next time, get an agreement in place before you receive the treatment.

I would write to the doctor and tell him what a poor way it was for his billing person to treat you. I'd then look for another doctor or hope that you do not get sick.

The bank sent a statement, telling me I had until Oct. 1st to pay up or they would file foreclosure. The problem is I received the notice after Oct. 1st and they already filed a notice in court in Florida the previous week.

The bank did say that if I was unable to pay by then, call them right away. I am considering this tomorrow, but I also thought about the possibility of retaining a lawyer to try to get out of this situation without obligation to the house or a deficiency.

My question is, do I contact the bank myself and try to see if they will make payment arrangements, or do I go ahead with the attorney and let him handle it?

You don't say who signed the mortgage. If you signed it, you can be responsible and could be subject to a deficiency. You should absolutely hire an attorney and not go through this procedure by yourself.

Try to avoid the legal "Foreclosure Mills". You will likely not get the individual attention your matter may deserve.

If you can find a lawyer that is familiar with the staff of the foreclosing bank or the foreclosing bank's law firm, then so much the better. That's when good settlements are most likely.

Why a lawyer? The reasons are many: (1) the proper application of trust law, (2) the proper application of probate law, (3) whether mortgage documents (including an original signed promissory note or an original executed [and genuine] assignment of mortgage and note) are missing, (4) the pre-suit conduct of the foreclosing bank and whether it was equitable, (5) the amount of time that will likely go by from foreclosure to an auction or to an amicable resolution, (6) whether the appropriate Bank officer(s) sign motion(s) for summary judgment, (7) defense costs (court reporters, mediators, process servers etc.) and fees- "hourly", "flat", or simply "reasonable" [quantum meruit], (8) the time you will need to take away from your own work and career to defend the foreclosure (your deposition, for example) (9) the affect of the foreclosure on your various credit rating reports, (10) whether a bankruptcy might be something to consider, (11) the applicability of Florida debtor protection laws, (12) what happens with your home while the foreclosure proceeds, (13) what about the Ad Valorem Real Estate Taxes?, (14) if your home is a condominium or there is a townhouse association- whether the Association will bring its own action to foreclose for failing to make maintenance payments.

I could probably list another 10 or so factors on top of these. Finally, don't pay more for a competent attorney than you can afford. Legal fees compound VERY rapidly. Be prepared and forewarned.

You have one year from the date of injury to file the claim, per the Labor Code.... whoever gave you that nov. 4 deadline must be addressing some other deadline.

YOU HAVE ALREADY 'FILED' THE CLAIM because the staff evaluated you and prescribed medication for a work injury.

The reason you cannot find an attorney is because you are -- in effect -- asking the attorney for work for free. The only physician who can evaluate you will be the prison-system physician, and he will write you fully recovered with no residual permanent disability ... and the attorney gets paid only if there is residual permanent disability.

That said, JUST REPRESENT YOURSELF. You're not real busy with anything else just now, you have access to the internet (or somebody in Yucaipa has internet access for you) and you've got virtually nothing to lose representing yourself.

I ended up meetings a guy at a hotel who was "supposed" to be from the adult video company and I did a shoot with him (had sex with him and allowed him to video).

After shoot, I showered and when I came out of the shower, he was gone.

I didn't get paid anything, he split!!!

I didn't sign a contract or anything like that and I don't have anything in writing.

Unless she is a licensed lawyer she cannot speak for him or represent him. That is the practice of law and she would go to jail if she practiced law without a license.

Your brother needs to sit down with a lawyer. Frankly he needs a lawyer in court. But even if he doesn't do that (and that can be expensive), it would be a huge mistake for him not to at least do a consultation with a lawyer. Money is not an excuse for not doing that. (My office charges $100 for an hour initial consultation).

Since contempt can land him in jail and cost him his job, he really needs to rethink not hiring counsel to appear in court. Going to court without a lawyer in a domestic case has the same chance of success as a gun battle where one side has a water pistol and the other side has an assault weapon.

Stress to him that his very freedom and financial future is on the line. It's not a time to pinch pennies.

What you can do is make a will with a trust in which they have a general power of appointment, plus they can take out what they want. When the die the remainder (if any) would go to the grandchildren. If your estate isn't large, this may be overkill.

It's inexpensive to have a lawyer do a will for you. Do not, under any circumstances, do it yourself. I see many homemade wills. They rarely work out well.

The one then got me in a head lock while the other struck me in the face several times. They then proceeded to call the police. You need a lawyer You would be very foolish NOT to go to the hearing--a warrant would be issued for your arrrest.You should see a lawyer about maybe suing the bar and the individuals who struck you and you should fight the charges.
