The community residents do not have deeded dock access. This particular neighbor has also been drinking beer in his vehicle on the easement and frequently trespassing off the easement.

It seems that your divorce is not complete. If that is the case, you should simply include a provision in the proposed decree that neither party pay CS to the other. If you guys are handling the divorce pro se (i.e., on your own) and you've already filed the petition for dissolution, you should, upon your final hearing, request the judge add language to the decree specifying that neither party has to pay CS to the other. Simple answer, it is 30% of his worldwide assets, including his share that he may already own with you.

So if the value of his joint tenancies with you already exceed the 30% of his total assets, he doesn't have to give you anything more.

So long as your assets are not placed in his name, people coming after him for anything cannot come after you. However, if you have joint bank accounts, jointly held property, funds in a joint bank account, and even joint tax refunds can be fair game to creditors. On the other hand, Child support rarely tries to attach assets, and will usually go after his tax refund, driver's license, or paycheck. Therefore, if something is yours and yours alone, his ex will not be able to take it.

The problem for you is, that the computer doesn't know all the rules, in all the right ways. Each docket has a maximum number of cases the computer can set without a manual override. when you bonded out, the computer checked for the next docket, that the officer was also scheduled for, and wasn't already full. Non one told it it had to occur within thrity days. If you go to the court, and ask that your matter be brought up as an add on, you or your attorney can get it straightened out

Depending on when the court date is, you should send the Notice of Intention to Defend in as soon as possible -- even if it is late. I don't know what you have done in this case or how it started out. If you were sued by the other party initially, that party is the plaintiff and you are the defendant. If you wanted to sue the other party, usually defendants file answers and if they also want to counter-sue, the defendant files what is called a counter-claim. Depending on if the facts are related or not, sometimes the defendant can file a separate lawsuit in which case the defendant is now the plaintiff in the second lawsuit.

The counterclaim (or original complaint) has to include a notice to defend. If you did not include this, then your counterclaim/complaint was improper.

I don't know where you appealed to. If the action started out before a magistrate, then appeals go to the court of common pleas. If this began in the court of common pleas, then an appeal usually goes to the Pennsylvania Superior Court.

Depending on what you did and whether the action was dismissed with or without prejudice, you may be able to start all over again, but this time, get a lawyer. If the words "dismissed with prejudice are in the order from the court" then you cannot refile anything. If the order is without prejudice then you can go back and do it right.

Complaints or counterclaims get filed with the court; you don't just send them to the other party. If this was not filed, it would also be a reason for the other side to ignore whatever you sent.

Since I don't know what was done or what you filed, I would take a copy of everything to an attorney or Legal Aid if you qualify. Failing that, then pay a lawyer just to consult with the lawyer and get their opinion as to what you did. It may be possible to amend what you did or start over as I said.

This isn't really a bankruptcy question, but I'll give you the information I have.

You need to get the lender's ok to file a deed in lieu of foreclosure. My understanding is that this option has been greatly limited quite recently.

Consult a tax professional about tax consequences of a short sale. The IRS website says there is no tax consequence for lender-approved short sales if the debt was forgiven in calendar years 2007 through 2012. So if you're going to do this, it would be best to get it done sooner rather than later. I don't know how the timing of this is calculated, but I do know that anything having to do with real estate is notorious for running behind schedule. Be aware of this for transactions that seem to be creeping towards the end of the year.

Generally, a creditor must have a judgment against a person before any bank accounts can be seized. Problems arise when an institution (usually a credit union) has a dual role of both bank and mortgage holder. It would be prudent to move your accounts.

Married couples hold property such as bank accounts in a tenancy by the entirety, so no worries if only one is obligated on the loan, even if there is a judgment against him/her.

If you are not in a marital relationship w/the obligee, but there is no judgment and the financial institution is not the lender, still probably okay.

In bankruptcy, you can write off a deficiency, such as might be owed to a lender if the house was sold for less than what is owed. But after the expiration of the Mortgage Forgiveness Debt Relief Act, there will be tax consequences, which will not be dischargeable in bankruptcy.

USCIS site visit on July 6,2010. Me and my Employer was present and given all basic info to Representative.

PERM and Labor Approved Priority Date May 22,2012

I-140 Approved September 2012.

March 14 2013 USCIS issue a Notice of Intent to Revoke the petition.

April 12,2013 submitted a response with required document.

August 26,2013 applied for Transfer for H1B with Company C got approval in January,2014.

November 6,2014 got latter from USCIS for petition revoked for company B.

Do I have to take any action based on Company B petition?

This is a rather complex case for this type of forum. I suggest that you discuss this matter with the attorney who handled the case for Co. B, who should have already advised you of the immigration consequences of having the petition revoked.

I cannot give you an opinion as to whether or not this will affect your greencard case with Co. B, because I don't know why the petition was revoked.

As for your employment with Co. C, it appears that you were in legal status when you transferred your H-1B visa. However, it depends on the effective date of the revocation (was it retroactive or as of the Notice date?).

They take about $90.00 a month. Since this deduction started, we have had to cut down on other expenses to stay within the budget that was approved by the Trustee. We are not asking to have our payment lowered, but having to cut down on other expenses makes it hard. My husband is only 3 years from early retirement age and has little in the way of retirement savings. We were not paying any 401K when we were confirmed. Can the employer do this? You should review your Chapter 13 plan with your attorney to determine whether you can modify your plan payments based on current expenses. If the employer makes their retirement plan mandatory then you should consult with your attorney to determine if modifying your plan payment is appropriate. Some employers do require a mandatory contribution into a retirement plan as part of their employment. IF the contribution is voluntary then modifying your Chapter 13 plan on the basis of this deduction will not be approved by the court. You really want me to tell you how to do this without paying an attorney (me, for example)? Yes, you can fill out the form with the proper reference to the Vol. and Page and date, have her sign, have 2 witnesses sign, have a notary acknowledge her signature, take it to the town clerk and pay the $53.00 for recording. I don't know how to get around the recording fee.

It sounds like you have bigger problems in life than a shoplifting charge, starting with being 17 years old and pregnant, and having associates who make you an accomplice to their criminal activities. You have a tough road ahead of you, and continuing to make bad choices is only going to make things more difficult for you and your child. Start with making a good choice, which is hiring an attorney before things go any further. (And find new friends. Someone who is going to involve you in their criminal activities and then not step up to say you had nothing to do with it is definitely not your friend.)

Hopefully you already have an attorney, because you should discuss this matter with him or her, and you should not make any statements to the police or prosecutors without your attorney present. Depending on the value of the items, the charge might just be a misdemeanor (although I suppose it's technically possible to take items of enough value at Wal-Mart for the charge to be a felony). But if you have no real defense, you may be eligible to have the charge diverted (meaning: if you do not commit any other offenses during the diversion period, the charge will be dismissed). Again, all things to discuss with your attorney.

I got a public defender but was given a more expensive lawyer because all of the public defenders were representing the other people who were involved in the case. The phone number I have no longer works. 4. If he is wouldn't that mean he has to do something about the judges lack of response? 5. Specifically, get a response and if I have not been convicted of any crimes since grant my motion for reconsideration?

6. If there is really no way to find my lawyer (if he left, quit, moved, etc), is the public defense office required to provide me with another lawyer?

1. No, there is not a time limit on the judge. Motions are not granted automatically. A motion held sub curia requires the defendant to request a hearing. Be careful of two things at this point: a) after 5 years the judges loses jurisdiction to change the sentence, and b) once the courts denies a motion the court loses jurisdiction to change the sentence. This could be important if the purpose of the motion was to change the conviction to probation before judgement and if that change has not yet happened. The time limits would be on the parties, instead of the court.

2. Contact the District Public Defender for the court where your case was heard and request their assistance either locating the lawyer who represented you or appointing a new one. Also, check for your lawyer's contact information with the Attorney Grievance Commission. There is a link to AGC at mdcourt.gov .

3. Yes, the lawyer is supposed to see your case through, and that is why the District Public Defender should help you.

4. He should pursue a hearing, if you instruct him to do so.

5. No one can compel a judge to respond, but judges usually do respond. The court would not have anything to gain by not responding to you.

You need to call the public defender. I'm not sure if they always handle post-conviction motions. But if anyone would assign you a new lawyer, it would be them. If they don't, I'd be happy to take a look at if for you. Mr. Welch's answers to the other questions are accurate. Don't wait more than 5 years from your sentencing date if you ever want to get a PBJ. And do it as soon as you can, because you will still have to wait 3 years for expungement once you get the PBJ.

If your orders do not specify that the person is to take the child to an in-network provider first, or only to an in-network provider, and if it does not state if you are to be consulted first if this occurs, and if the orders don't state what is to be done after that, such as if the in-network person can't treat or if the parent chooses to go to an out-of-network provider, and if the medical expenses are incurred, and the child needed or needs the medical treatment or consultation, you more-than-likely will be required to pay your percentage of any medical cost not covered, what ever that is and based on what the order states your percentage is.

You can't argue that there is a violation of an order, if there is not specific language drafted and entered to cause a violation. Also, if you do not pay what ever your part is of the medical expenses not-covered, then that non-payment will more-than-likely cause there to be a violation on your part.

Again, read your orders, and if this continues, you may want to go back to have the orders clarified and you can retain a qualified custody lawyer to go back to court and get the orders clarified.

Not until the child is born. Once the child is born, you can file a petition to establish (or not) paternity, and in that court proceeding she will be required to admit the child is not yours or submit the child to DNA testing (nothing but a QTip cheek swab these days). If she and her husband were cohabitating at the time of conception, however, you may not need to bother. There is a legal presumption that the husband of a married woman is the father of her children unless he can prove they were only legally married but not living as husband and wife at the time. If they were cohabitating, the burden is on him to file a proceeding to establish that he is NOT the father.

I am going to have to disagree with Mr. McCormick. You don't have to wait for a child to be born, you can file a petition for paternity if you think she is pregnant with your child. The form clearly allows this option.

You may have problems, however, after filing a petition with the presumption that Mr. McCormick sets forth regarding the presumption that the husband of a married woman who is not sterile and is cohabiting with her is the father of the child. You do not state whether the husband is sterile or whether they were cohabiting.

However the pre-natal testing is sufficiently invasive, that unless there is some great urgency, or the petition is filed by the mother, it is extremely unlikely that a court will order a test before the birth. Right? No. Legal? almost certainly yes. Except in San Francisco (and maybe some So. Cal. municipalities I don't know about) there is no legal right to paid sick time off, even if you are a full time employee. There is no right to vacation time either. Your company legally only must pay you minimum wage, and overtime if you are non-exempt, according to the pay policies and benefits in place at the time you work for them. They cannot retroactively change the terms of employment, but they can set whatever policies they want as far as sick time, and they can change them on a going forward basis at any time. They can also take away accumulated sick time, as long as it is not after you took the time off in reliance on a paid sick leave policy, Accumulated vacation is considered earned in full when worked and must either be allowed to be taken or paid out at the end of employment with the company.

Of course you can go. You can also take your children. I doubt very much that any competent police officer would take a complaint and, if so, that an Amber Alert would be issued. As long as the two of you are not legally separated and there are no court orders entered restricting travel with the children, It sounds like he just tired of spending Thanksgiving with your family every year. Maybe you should stay home and start your own family tradition with your husband and children here.

She would be entitled to an equitable division of all of your assets, including your retirement or pension that was acquired during your marriage. As for the property titled in your name, alone, it depends if you acquired this property prior to the marriage or with money/assets that you received prior to the marriage or if you received any inheritance. There also are other ways this property may be considered separate under the Ohio Revised Code. See Ohio Revised Code 3105.171(A)(6). She probably would not be awarded spousal support for very long, if at all, because the marriage has only lasted four years. In addition, there has to be an equitable division of all debt.

I would say the answer to your first question is probably, "yes." By giving its approval the HOA agrees not to interfere with the modifications and the homeowner agrees to follow the approvals. As long as there is a meeting of the minds on what the approvals are, I'd say there is a contract. Once there is a contract neither side can unilatrally modify it. So both HOA and homeowner are wrong. If the homeowner is unable to perform the contract as agreed due to mutual mistake of fact, specifically that he could make the modifications as agreed without violating the relevant provisions of the building code, the contrace may be (probably is) voidable for mutual mistake. The HOA and the homeowner then have the option to cancel the contract, or negotiate a modification. Neither has the right to unilaterally simply change the terms. If homeowner proceeded with modifications that did not conform to CC&Rs;and the agreed approval, the homeowner has acted illegally.

Rather than asking for documents, it seems to me it would be worth while to run all this by a competent real-estate attorney in your neighborhood. It might cost you the equivalent of a month's payment or so to have good advice. Assuming the second is a standard note and deed of trust, you should be looking for a full reconveyance from the trustee, surrender of the note, and something in writing explaining the deal and signed by the lender; I'd be cautious about any rights the lender retains and in particular I'd look for whatever the lender is getting in return for making what sounds on its face to be too generous to be completely true.

In Ohio, much depends upon who did the damage and who is on the lease agreement. If the others that you metioned were on the lease agreement, then they are necessary parties to the lawsuit and the failure of the Plaintiff to include them is a defense that you have against the lawsuit.

If these other persons were guest, then there is case law that says that if you can show that the damages sought were caused by these other persons without your knowledge or consent, then you cannot be held responsible for them (the case is Allstate v. Dorsey).

If much of the damages arise out of unpaid rent, then if you can show the court that the landlord did not take the proper steps to mitigate his damages (trying to find another tenant to take your place) then these damages too will not be allowed.

They also need to give you credit for any security deposit that you gave them at the start of the tenancy.

You should file some sort of an answer with the court denying the charges. You will probably want to hire a local attorney to assist you with this.

Absent a contract, there is no guarantee that your working conditions will not change either with your current employer or, as here, with a successor. If you are unhappy with what the employer offers, you have the option to quit. If the change in working conditions is sufficiently different that it constitutes a constructive discharge, you may be able to win an appeal for unemployment compensation. However, you could lose and have to pay any unemployment pay back to the State. It is a difficult choice but it is the one that you have.

Broadcasting television over the internet does not require any FCC permission, however needless to say that you/they should form a company in the U.S. to facilitate this activity here.

If you will be their business partner and/or an independent distributor you have to enter into a proper licensing agreement with the German company as well as into business agreements that would evidence the business arrangement that you have with the parent company. In addition, you should consider entering into is a distributor agreement which would in effect give you exclusivity over the distribution of their TV product in the U.S. and maybe also Canada and other countries in the Americas (as a side note, though it is difficult to give exclusivity on the internet, nonetheless, I have successfully negotiated agreements that assigned territory and exclusivity to internet ventures).

If, on the other hand, you will be an executive working in their U.S. subsidiary then you would need an employment agreement and equity agreement if you will be receive equity compensation and the entity would need various corporate governance agreements.

An attorney may be able to defend the charge, or at least negotiate a plea bargain that would avoid your son taking a conviction for this offense. been researching this for months. A person gifted me a car (in which I have proof that it was a gift) They financed the car and everything was in their name.They also told me that I owe nothing for the car and that they were going to take car note. I have a witness to this statement. So one day I was driving and I neglected to put my seat belt on. The officer asked for registration and insurance. I only had the car for two weeks and the officer would not take the paperwork that is affixed to the windshield from the dealer. So the officer impounded the car. The person got the car out of impound and gave me the car back. A few weeks later they told me that they wanted the car back. Initially, I refused because it was a gift. They told me that they could not make the payments for the car. I offered to make the payments for them. They said no. I gave them the car back and now they are writing me letters stating that the car is a hardship (i guess that the dealer would not take the car back or they did not take the car to the dealer.) In the latest letter they sent me, they stated that my keeping the car was conditioned if they were to receive the settlement that they were expecting. This issue was never brought to my attention. Needless to say they did not get the money. They have the car and continue to write me letters. Do I have any legal obligations? and what can I say to the person to make them understand that they have the car and now it is their problem. I offered to make the payments and they refused to accept. And can I inturn sue them under the fraud and misleading?

First, a gift is ordinarily complete and final when the possession of the item is turned over by the donor to the donee with the express intention of making a gift of it, and the donee accepts it. However, transferring ownership of certain property also carries with it a requirement for preparation, execution and filing or recording of certain paperwork. Examples include real property and automobiles. (Note that automobiles are NOT real estate or real property. They are personal property). Also, transferring ownership of property encumbered by a lien does not transfer the property free of the lien; the lien remains attached to the property. So, if someone gave you an automobile as a gift, there is an argument that failure to complete the DMV paperwork to transfer registered ownership fails to transfer legal ownership. Also, any financing done by the buyer would stay in place and the lender's right to repossess the vehicle would not be affected by the attempt to give it away as a gift.

You can't get guardianship without an attorney and you can't get conservatorship without a court battle (probably). But in 2007 the Texas Legislature added a new section to the Family Code (Chapter 34) that addresses just this issue. Your daughter can sign a "Non Parent Relative Authorization Form." No lawyer required.

Good question. It's "legalese". :-) The short answer is that it technically means whoever has asked for the Lease to be terminated/cancelled has paid the other party a whopping $1.00 for the right to do so. But you should also know that this type of language is VERY COMMON in most contracts -- it's simply form language that sets forth the "consideration" paid for the deal. A court will not enforce a contract if there is no consideration.

When you enter into a contract (in this case a lease) with another party, both sides have to give something up (called "consideration"). As a tenant, you promise to pay rent. That's the consideration the Tenant brings to the table. A landlord's consideration is typically his agreement to allow the Tenant quiet use and enjoyment of the property (and sometimes Landlord has certain maintenance obligations). But just in case there's ever any confusion about whether there is consideration set forth in the contract, the form language you quote above is used so that the parties have agreed that $1.00 is the consideration. $1.00 may not seem like much money, and it's not, but it is enough for the court to find that consideration exists and therefore a valid contract exists.

With that said, every lease is different in terms of what has to happen for either the landlord or the tenant to break the lease. As such I would STRONGLY recommend that you allow an attorney to quickly read your lease and advise you of your rights, unless you are happy leaving your space. If you are not thrilled about leaving your space, and the landlord is forcing you to anyway, it may be worth having a lawyer read your lease to see what your options are. You may not be able to stay in the space, but you may be able to extract some concessions from the Landlord (money for your moving costs, money for your time/aggravation, extra time to move out if you need it, etc., etc). If you have questions about the consequences of signing the termination agreement, I would STRONGLY recommend you retain a Maryland real estate lawyer to quickly review your lease and advise you of your rights BEFORE BEFORE BEFORE you sign ANYTHING. No. Its not an inheritance. That's nice that your father's siblings want to give you something, but it would be a gift. They can gift up tp $13,000 to you (each person can give you up to $13,000 each year). Anything over that will subject them, not you, to gift tax.

My question is what does the will say about excluding you from the will? Depending on what the will says, you may be able to make a claim. I would sit down with a probate attorney in the county/state where your father lived at the time of his death and pay him/her for 30 minutes of time and to review the will. It may be that if the will is invalid for any number of reasons and you can bring what is called a caveat (challenge) then a family settlement can be reached and you will be included. In such case, you would then probably have to pay inheritance taxes.

I would explore all options to see how you can best maximize your benefit and minimize the taxes.

This type of question is really impossible to answer without a review of all the relevant documents [Will, etc.] and a meeting to review all the relevant facts. That said, I don't know why the attorney would not want the Will to be probated...that seems like a logical first step in the process.

The problem I am having is that my ex likes to sign them up for all kinds of activities during my visitation time which I think is to force me to have to make multiple trips back and forth to their town and basically leave me with no time of my own with them. For example this weekend I pick them up after school, then one has an activity at 6. The following day they have activities at 9:30am, 2pm and 7pm. Then Sunday they have activities at 8am and 11am. Charged off does NOT mean you don't owe a debt. It is a derrogatory entry on a credit report that essentially says the creditor considers you a deadbeat who is unwilling to pay. Generally, charged off debts get sold to collectors and you get sued. Once you get sued, you need a lawyer as in yesterday. Do NOT answer the case yourself! You may waive or lose defenses if you have any, and will lose the case. You CANNOT request a payment plan from a court.

See a lawyer to determine if you need to go bankrupt, or if you have a proper defense. After 30 days you have waited too long to see the lawyer.
