My mother-in-law helped us purchase our first home and also has lived with us since that time. After closing we had the attorney file a mortgage (Promissory Note) recorded with the town land records with her as the Grantees and my wife and I as the Grantors. We have been living there for 8 years now and she would like to remove/release the mortgage on our property. I have seen forms for Release of Mortgage or Lien. My question is do we need to pay money for an attorney to get this removed? Or can we fill out the form and have her sign it in front of 2 notaries and recorded with the town?

You really want me to tell you how to do this without paying an attorney (me, for example)? Yes, you can fill out the form with the proper reference to the Vol. and Page and date, have her sign, have 2 witnesses sign, have a notary acknowledge her signature, take it to the town clerk and pay the $53.00 for recording. I don't know how to get around the recording fee.
