First determine if you have insurance or if your parents' insurance would cover the incident since you were driving their car. Your parents should talk with their agent. If you do not have insurance and are sued, you definitely need to hire a lawyer immediately.

You can find people's addresses all kinds of ways and you will need to do that in order to sue. If more than $5,000 is owed then you need to see an attorney. In most types of cases, you cannot recover your legal costs, but you should discuss that with your attorney.

Not sure what the DOL is. Department of Labor? You didn't state where you were born. You may be able to contact that state's government and obtain on an expedited basis a certified copy of your birth certificate. Ditto for the military and AZ for a replacement of your driver's license. Your ex-wife has commited the tort of conversion of your property, etc., so you have an action against her. She has also committed theft, so file a criminal complaint. Ask the DOL what the statuatory basis is for them denying a photo ID.

Most leases contain a roll-over provision so that it turns to month to month at the end of the lease. So for starters you need to read your lease carefully. If it contains such a provision, you must give them 30-days notice to move out, if they have been there less than 12 months, or 60-days if they have been there more than 12 months by the end of the lease. If there is no roll-over provision, you have no specific deadline, but the sooner you tell them that they will be trespassers at the end of the lease, the easier it will be on everyone. Then if you want to move them out, do not accept rent for any time past the end of the lease, and file an unlawful detainer as soon as the lease is up.

You need to finish your divorce and get it finalized. However, that will not necessarily stop the investigation into adultery. They can walk onto property (not curtilege) if that area of the property is openly visible and they have reasonable suspicion (no registration). However I would argue they cannot tow the cars off of private property without a warrant.

I have a membership certificate that certifies I own .5% units in the company. I also have several emails stating his promise to repay, even after he took the website down, similar to this:

I have requested my money back, along with other investors who are in the same position as I. He has made emailed promises to me thru 2013 to refund my investment. To date, I have received no refund. What are my rights? I never was able to inspect the business' books nor records.

It's very difficult to answer your question without knowing what is involved with the estate. Some things take longer than others to resolve (property issues, finding lost heirs, etc.) On the other hand, life insurance policies are usually rather straighforward UNLESS there is a dispute over who the beneficiary should be.

There is no typical timeframe for opening and closing an estate, however, if one starts to go toward the 2 year mark, there must be a dispute that is causing the delay. If you suspect that this is not the case, then your father should have another lawyer review the situation and give him an opinion on why the estate has not closed.

There really is not much you can do. It is your burden now to find any assets that the defendant has and then your burden to prove that he has them. The law in, South Carolina does not permit the garnishment of wages or seizure of bank accounts. You have a lien on any real property that the defendant has in the county where the judgement is filed but you wilk have to wait until the property is sold to collect.

Still, it does not make you personally liable or put any assets that have always been in your name alone in jeopardy. It can be a very fact specific situation so your husband should seek the advice of an attorney as it relates to both of you to confirm you have not missed something in your explanation and understanding of the situation. Also he may not be able to be held accountable at all depending on the divorce judgement and when it occured. It could have been an assumed risk if the terms of the divorce did not require her name be removed immediately.

It would help if they kept a copy of the one they originally completed or if you can give them your copy (if they provided you with one) so that all they have to do is copy the results, have the civil surgeon sign it, and put it in the sealed envelop. Just explain your situation, and the physician may work something out with you. Hopefully, your exam wasn't done over a year ago or you will have to go through the whole process again.

It has been my experience that most people's body will process marijuana in such a manner that it will not remain in their system for more than 30 days. After 60 days, there should be no trace of marijuana in your system. Perhaps there's a problem with their test kits. You have a right to have your own independent test performed by a lab. You might want to have a blood test done, as it's more accurate. The cost of these tests is minimal incomparison to the cost of a possible 2nd violation of probation and where that may leave you.

On move in day, I was expected to pay my rent and deposit and I was also supposed to sign a lease that was month-to-month and receive keys. That day, the son told me that he had been very busy and had not been able to pick up the lease, but I could still move in as long as I paid the money but there will be a lease shortly. Having no place to go, I went ahead and moved in. To make a long story short, I had been asking for a lease constantly, and the son pushed it off, saying he had been busy but not to worry. I began to look for another place to move, but unfortunately 3 months down the road I was still there, and there was no lease. Then, I received a call from the home owner (the father) saying that I needed to move out by the end of the month or sooner due to his daughter needing to move back home. The son had known this but did not tell me sooner because he did not want me to leave early and leave him without money to pay the mortgage. The son said that as long as I cleaned the room and there was no damage, he would return my deposit. I had tried to meet with him the week I left but he was out of town. I called and texted him continuously after moving, and all I got was "I need a few more weeks". Soon enough, he stopped responding entirely. I was not even able to return my keys or get items I forgot. I called his father and his father said he had no knowledge of a deposit and if am to get it, it would be from his son. The son does not respond and it has been about 6 weeks. I have two old roommates who lived there that are aware of this situation and know that I paid a deposit. I have proof of emails and texts of the son acknowledging the deposit and promising that he would return it. What can and should I do?

File an action against both the son and homeowner in small claims court in the county in which you live. I am assuming you are not in the City of Chicago. Check you local jurisdiction for laws on return of security deposits. You could be entitled to a penalty.

If he has been charged, the conditions of his bond will determine the answer to your question. Often, but not always, bond conditions on a person charged with a sex crime against a minor will require that person to have no contact with a child under a certain age. Look at the bond paperwork and see if this is the case. If so, he will have to file a motion to modify that provision to provide an exception for his children, and it will depend on the circumstances of what he is charged with as to whether or not a Judge will modify the bond. Otherwise, having contact with his minor could land him back in jail for violation of his bond conditions. The same is true if he has already been convicted, with the exception that you would need to look to see if there is a no contact provision in the sentence entered by the Court. Finally, as the mother, you need to exercise discretion as to whether or not you should let him see his children. Depending on the nature of his charges, allowing your children near him could end up with DFCS becoming involved and possibly taking the children away. If this is an ex, and he has visitation rights, you should contact an attorney, take the bond or sentencing paperwork to them, and get some advice on how to handle this from a visitation/custody standpoint.

Does it violate any deed restrictions in your neighborhood? If so, you cannot do it.

Technically this is complex. He is technically liable for half the benefits and half the liabilities of the house. So if you receive rent, he deserves half of it. But, on the other hand, he is supposed to be paying half the expenses too. So, you can see, it is not an easy answer.

So if you are not violating a local deed restriction or local law, I guess, you can get a roommate.

You did not mention if you have minor children in the home. If it is a person of the opposite sex, and there are minor children in the home, that might be a totally different problem if your husband does not like you having a "roommate".

I hope that you will retain the services of an attorney soon to help you with your divorce.

Bankruptcy may be an option when someone faces a lot of debt and no realistic means to pay though there are costs associated with filing for bankruptcy. The man who assaulted me has done this kind of thing before to others. I fear he may do it again. I'm also not happy with the way the recreation center treated this. The other drivers state of intoxication does not affect your brothers DUI conviction. It could l affect his conviction on at least one of the battery charges (if he was accused of battering that driver), as long as the issue was explored at trial. If the prosecution withheld the information of the other driver's intoxication, your brother's attonrey may be able to appeal that conviction.

But, 72 months on a 4th DUI may be wll within the guidelines, without consideration of the Aggravated Batteries. 60 ,omnths woudl be within the guidelines for the 4th DUI, Therefore, 12 months for 3-4 ABs may be within the sentencing discretion fo the judge. If your brothers intoxication coupled with teh only other party/victim's intoxication, may be enough to negate all the batteries.

These determinations are very fact-specific and require much more information than you can provide here. If our brother wants to explore his appeal prospects, he shoudl consult with his trial attorney as soon as possible. If he is not satisfied there, you may need to hire an appellate attorney for him.

You can give her notice now to leave at the end of March assuming she pays on a calendar month basis. We went through several emails for information, then he changed to puppy into my name and took him to a shipping firm called Pets Transportation, and arranged to have him shipped to me. I was emailed by the shipping company and told I had to Western Union $350 to cover the cost, then after I sent the money, received email from them that everything was cleared and the dog would arrive at my home at 7am this morning. At about 5:30, one of their reps called to say I had to purchase VPI insurance before the dog could be shipped. He told me if I didn't pay this I would be charged with animal abandonment and go to prison. I also received emails from the company to this effect. I told him I had no money to pay. He supposedly talked to the board of directors and they said they would settle for 1,000. He then offered to pay 500 if I would western union the other 500 so he could ship the dog. He was very agressive in trying to talk me into wiring more money. I tried to dial star 69 to get his number to call him back but the number in not available. I emailed the owner of the dog and the shipping company but neither is emailing me back. Have I been shammed or will they actually file charges against me and make me go to jail? I am a nurse and could lose my license if arrested and found quilty of crime. I am very concerned. What should I do?

His recourse is to answer the lawsuit. If the State can prove that the money derived from the sale of drugs, was intended for the purchase of drugs, etc., then the money is subject to forfeiture.

He needs a criminal lawyer. Hire one and confer with the lawyer on this matter, too. It may be an avenue of the lawyer conducting some discovery on behalf of your son.

I started treatment a month ago and on my second round of medication the pharmacy screwed up and didnt see in there system that I paid my co pay (even tho I did) so they decided to not send my life saving meds. I was in a car wreck tuesday, i dont remember anything during the wreck i was passed out in the car when we was hit, i was the passenger and my bf was driver he left the scene. but my question is if i am complaining of head, neck, and shoulder pain and had a headache and was passed out to where i dont remember anything except standing out side of car, should i have got medical attention imediatly (sorry having trouble spelling from wreck) and i had a cop that kept making me stand up and move around asking me questions and making me panic more when i was in in total shock and couldn't stand from shacking bad, and wasn't coherate to what was goin on. i didn't get any medical attention till a hour and half later when a cop asked if been seen yet andi said no, at that time the paramedics had everything put up and wasn't going to give me medical help, i had a concusion from it all. i could of been injured badly but luckly i am jsut bruised really bad and having trouble with ribs and chest now but got x rays and waiting for results on that. but my question is when the paramedics first got there should i of gotten medical help fast just like the other people in the other car. theychecked them out and didnt even acknowledge i was there. i wa somad bout waiting for medical help and got it a hour and a half later so i refused them to take me to hospital cuz they would have to call another ambulance there. the hospital put me in a neck brace as soon as i got there? can we sue them for not giving me no medical attention and sue the cop for making me panic more when i was in a concusion and not coherate at all. the cop kept threatening me and sayign i was on drugs when i dont do drugs i have astigmatizm in my eye but he made me move my neck back wards and side to side with out me being checked out by a paramedics?
