Technically probably one mile over, I do not know if there is a consensus in New Jersey or elsewhere, maybe there is. In the 18 plus years that I have been handling speeding tickets and other municipal Court matters I have never seen anyone incarcerated for a mere speeding ticket. Generally there is a Threshold regarding suspension of a person's driving privileges. Generally if you are traveling thirty miles over and/or more likely if the person is clocked at 90 or higher there is often a higher chance that a Judge will suspend a persons License or the prosecutor may request one. I have represented people on tickets where they were alleged to have been traveling as fast as 106 in a 65 five and the person received a suspension but was not incarcerated and I was able to lower the points. It depend on the Judge and the facts. I was in a Court where a Motorist was charged with allegedly traveling 123 in a 55 or 65 (I do not recall) and he received a fairly long suspension and a stern warning from the Judge and he was not incarcerated. If you crash a car at a high rate of speed and kill someone, then you have most likely opened the door to a Jail cell if the person is charged with a criminal charge for acting recklessly. I would not recommend speeding to test your proposed theory because it is really worth testing how fast you need to go to push a Judge into considering jail time. I was also in a Court where a young kid was alleged to have been traveling 141 in a 55, I did not hang around to learn the final outcome, but I know that his lawyer was concerned. Everything depends on the facts, were you on the highway, were on a residential street with children present, The statute permits a Judge to put you in jail for speeding, also just because I have not seen it does mean it doesn t happen depending on the situation, but it is an extreme penalty where the only offense the person is charged with is speeding. You did not sign a lease with the landlord for back rent. That is his problem. You are only responsible for the lease that you signed with the landlord. As far as the title to the trailer goes, if she signed the title to you - take it to the tax collector's office and finish getting it put in your name. Title search is only needed for the land - do you own the land - obviously not if you are paying for the rent of same.

The final judgment grants you the status of primary residential parent. What that means, in plainer language, is that the Court expects you to have your daughter live with you. It sounds to me as though this custody battle was an actual court trial (rather than a result reached by agreement). If that's true, the Court found as a matter of law and fact that it is in the best interests of your child that she live with you. To send her to live with your ex for a year would violate the Court's order and presumably not be in your child's best interests. Plus, it would give your wife an opening to try to modify the final judgment and get her declared the primary residential parent, as you pointed out. Additionally, it creates issues with child support and time sharing. If I was your lawyer, I'd advise against you letting your daughter go to live with your wife for a year.

I don't think Mr. Collins and Mr. Whipple carefully read your question. During refinancing, the former lender is paid off. The former lender then requests the trustee to execute a deed of reconveyance to you, which clears the original deed of trust. If the trustee named in the original deed of trust is unable to act, the former lender uses a document that accomplishes both of these, a substitution of trustee and a reconveyance. The substituted trustee then reconveys, which clears the deed of trust.

Nothing mysterious or nefarious is going on.

1. Don't pay the $1470. You didn't breach the contract, THEY did. They showed you one thing but sold you something else. They're liars and crooks.

3. Write these folks a polite letter (PAPER letter - no emails or phone messages - put a date on the letter, and keep a copy) and tell them what happened. Tell them you're not going to pay the $1470.

In the United States anybody can file suit. However, if her customers file, it is unlikely they will win.

Lawsuits are about recovering damages. On the facts you describe there are no damages that these people suffered beyond hurt feelings. They were served, they ate, and they even got their money back.

I would be more concerned abour your sister keeping her job. Make sure she explains her version of events to the manager.

If you give up your U.S. Legal Permanent Residency now, & want to re-apply in the future, then you would have to meet the eligibility requirements & go through the entire process all over again.

Remember that you would then require a U.S. visa in order to enter the country, & any immigration petitions you may have filed on behalf of any relatives will be revoked or denied.

You should also contact an accountant regarding any potential U.S. tax issues.

If you need to depart the U.S. for 6 months to 2 years, I would recommend filing for a re-entry permit instead of giving up your "greencard".

Presumably you carry homeowners or renters insurance with liability coverage for such incidents (every parent should), so you report it to them and let them sort it out.

If those funds are community property, then any property purchased is community property. One spouse cannot make a gift of community property to himself as separate property. If those funds are separate property, however, then his purchase of property is also separate property.

Mr. Roach is correct. The source of the "extra cash" is what determines whether or not you have a community property interest in the rental house. I write separately to bring up a couple of other points. First, you say he brought his father in on signing title. Your husband does not sign title as a property buyer, the sellers do. So did you mean your husband had the sellers name his father on title along with your husband, instead of you, or do you just mean his father went with him to the escrow closing? While a person cannot make a gift of community property to themselves as separate property, they can make a gift of community property to a third person. If the source of the funds was community property and your husband had his father named as a co-owner by the sellers, he gave away your money. On top of that it could raise tax issues for which you could be liable. My second additional point, is that if separate property of your husband was used to buy the rental, so it is his separate property, if he has to use money from sources other than the rent to pay the costs of ownership, maintenance or improvements to the property, that will create a right of reimbursement to the community if you divorce or for estate planning purposes. So clear accounting of the expenses of owning the rental need to be kept.

Does the settlement agreement or judgment of divorce indicate how the agreement is to be modified. Usually it calls for the consent and signatures of both parties and notarization. If it has been more than 5 years and ex-wife had still not paid, then ex-husband may consider filing a complaint for contempt before she can take any further action. Given the circumstances, the ex-wife would likely not be in contempt, but it could force a hearing on the issue.

I think more information will be needed about the circumstances of the agreement that was signed, i.e. was it signed on a napkin after 4 glasses of wine and a romantic dinner, or was it prepared and considered and signed with the intent to be fully bound? While ex-wife will have to overcome procedural hurdles, ex-husband will have to overcome the fact that adults are free to contract and agree as they wish.

First of all, DMV and the Courts conduct totally separate proceedings.

In order for DMV to suspend your license they have to show that you were 1) lawfully arrested; 2) you were the person driving; and 3) when you were driving your blood alcohol level was .08 or above.

However, if you are under 21, your license can be suspended when your blood alcohol level is over .01. Or, the DMV proceedings may still go forward if there was a "refusal" allegation.

Your question doesn't provide enough information to determine why DMV would go forward if your blood alcohol tested at .05.

Venere.com used my credit card details to make reservation and told that I will be charged at Hotel check-in. They didn't charged my credit card. When I went to hotel (Florida), Hotel said, we have not received any reservation through Venere.com and we won't be able to give you room. I called Venere.com Customer Care, they said "our system is down we can't check anything. We have not charged your card, so you can make a different reservation if you want. We don't take any responsibility" . They are

not willing to take any responsibility nor compensate for high price I had to pay to pay for such instant reservation. I had very bad experience and difficult

situation with them. I have a reservation confirmed email from Venere.cpm and the Hotel gave me a written statement saying they have not received any reservation from Venere.com and Venere is not taking any actions nor helping me with situation. I want to take firm action against them or have atleast my additional expenses covered.

A letter from my MD 1.5 yrs ago was given to them regarding my mental disability and that i might require reasonable accommodation. My problem was my ignornace of ADA rules and therefore never asked for RA [time off to rest], therefore my absences have been chalked up as excessive sick leave and i am about to be fired in 1 week. Is it too late to go back and request that those absences be attributed to the need for RA [my MD has been treating me] so as not to count towards my termination? They were on notice 1.5 yrs ago about my disability but they NEVER asked me about how they could accommodate me. Is it their or my responsibility to be informed and to make the requests. It's never too late to make the request until after you have been terminated. Although it will not look good to make the request now as opposed to earlier, it will not hurt to do it now. Additionally, the FMLA may also provide some relief depending on the exact nature of your absences and your condition.
