What can be done for someone writing a bad check and causing fees to be incurred on my account.

Question

What can be done for someone writing a bad check and causing fees to be incurred on my account.

Answer

First of all, as you have learned, never write checks on a deposit until you know it has cleared. That means ALWAYS wait at least 5 or more business days (longer in some cases). Generally you'll be responsible for any overdraft fees you incur if you do not wait.

Second, your remedies depend on what the check was for. In some cases you have a civil remedy, and in some you have a criminal remedy, and that varies by facts you didn't give. There is exact language you must use in written notices for either, and since you left out the needed details, discuss those with your lawyer.

Question

you ask to buy a house and pay down payment to someone who says she is an agent of the owner. You sign papers not allowed to even view and cannot read them because she took your glasses and you are not even given copies but told you will be sent copies to your new address and that you can move in right away. You trust her and the so called Lawyer that sell you this house and later find out it is all a fraud, what can you do and is there a limitation of time to file against her or her and him?

Answer

First, from your post, you were quite willing to sign your name without reading and with someone keeping you from reading. With few exceptions, that is not going to get you out of a contract. However, assuming it was all a fraudulent scheme you can sue them. Do you know their real names and where they live? DO they even own the house? Call a lawyer in the area, and call the police. They may be doing it to others.

What is the difference between creative professionals and creative entrepreneurs?

What is the difference between creative professionals and creative entrepreneurs?
My new book will explore the difference between a creative endeavor (a profession that is creative by nature, such as an architect, or a musician) and a profession done creatively. I will argue that any profession can be done creatively, but some lend themselves to creativity more than others.I guess you'll have to read my book "How to be creative in a nutshell" to find out the answer to these and other interesting questions.

Traffic law window tint.If you are pulled for dark window tint and the officer tells you to roll down your windows so he can check the tint ...

Question

Traffic law window tint.If you are pulled for dark window tint and the officer tells you to roll down your windows so he can check the tint with a device. Do you have to roll your window down and what are my rights?

Answer

Roll it down, or they will break the window and drag you out. Getting dark tinted windows is not an excuse to refuse a check for dark tinted windows. That is like the guy who killed his parents and wanted a break because he was an orphan. Officers also have the right to make sure they are safe, so they are not leaving people in the car they can't see.

Answer

You likely have two choices - roll down the window or risk that the officer will perceive your actions as a threat and break the window - and arrest you (if not shoot you depending on what they think you are doing with your hands). That is not the time to be a smartass. If you think the stop is improper, get a lawyer later and challenge it. Don't debate the guy with a gun and a ticketbook over something so small.

Question

I just received an e-mail from my attorney that my "divorce matter is set for dismissal on the dockets Oct. 12,2012" They have left the office...i am in shock..What does this mean?? My husband filed in May,2011. My answer was given..It IS A FAULT DIVORCE..With Me being the faulted party..there was fraud, forgery, theft of my seperate property, abandonment...On and on.. PLEASE..I need to know something. Thank you

Answer

Not to worry. That is still a month away. Call your lawyer tomorrow. Courts routinely put all cases on a dismissal docket for docket control. It is merely a time for the parties to acknowledge that they are still litigating. Often people will file a case, and then leave it dormant forever, and it just clogs the docket.

Answer

Teresa's answer is correct, but there is one thing that you should know. When a court puts a case on the dismissal docket, the typical way to get it off is to set the case for trial. Some courts will remove it from the dismissal docket only if you set it for trial; sometimes quickly. If you have a serious case with lots of issues, as you apparently do, then it is imperative that you get all necessary investigation and discovery done immediately. Most discovery has to be requested 60 days before trial. Once a case hits the dismissal docket, even more diligence than normal is required.
