i feel as though i was mistreated. today while i was on my lunch break i took one of the vendors who does a-lot of work for me at my place of employement. we went two blocks from the job, on our way back we saw traffic was at a stand still, as we turned into a parking lot on the left enclosed by an iron gate to get out of traffic i noticed it was a police check point. i told the driver and he stoped in a parking spot to look for his License. he told me he didnt have his license on him. he asked me if i had a license i said yes and agreed to drive us back to work. as soon as i got my seat belt buckeled apolice officer pulled up and apporoached us. he asked what did we just do and i told him "my friend doesnt have his liscence on him but i have mines. he took us both out of the car put us in handcuffs that i still have marks from 7 hours after the incident. i explained to him i didnt know i did anything wrong, and that i wasnt trying to run. since i was honest from the begining i didnt understand the hostility. he ran the car tag and my information and my friends, as he threatened to take us to jail i explained that we work across the street and that we have APD officers that work with us that could vouch and verify who he where and that the he was blowing the situation out of control. after communicating with a sgt that was at my job he agreed to not take us to jail. he gave me citation for evading the police, obstruction,and allowing someone to drive with no license. in my mind after he verified the information and listening to our reasons and explanation was i mistreated, and should i get an attorney or will a public defender or judge understand, and be able to resolve this.

Understand what? You went out to lunch with a person that does not have his driver's license. When he informed you he did not have his license, you agreed to drive his vehicle back to work. The police stopped you and asked you what was going on, and you politely explained that the passenger did not have a license and that you agreed to drive his car back to the office. Neither the police nor I am stupid. With that story, the police would have arrested your friend for driving on a suspended license, or driving on no license, and that would have been the end of it. However, I suspect that you started running your mouth, about why the police were stopping you, and how you had to get back to work as if the police were inconveniecing you. You need to confirm this information with the school principal or someone with the school district's administrative offices. I recommend that you contact the Family Law facilitator at the court where you filed the custody petition. It should be possible for you to be granted a temporary custody order that specifically directs that you have sole custody until the matter fully adjudicated or at least through the first hearing date.

The only way to remove your name from the loan and mortgage documents is to refinance the loan into your ex-husband's name alone. I have to assume that you were unrepresented in your divorce, because there should have been a provision that - if he is to keep the house - he must refinance the loan into his sole name.

You should take your divorce decree or separation agreement to an attorney right away. Your ex-husband may be in contempt, or he may not be, depending upon what he was ordered to do with the house. You probably have many more months before the bank steps in and takes the house, but you don't want to wait! He cannot have the police remove you from the premises since you still own it.

But it was loosened up recently a slight bit to allow a conviction to be set aside if the person has a "minor conviction" in their past. I have printed copies of all statements to show him the account for our son has remained stable since our sep and divorce and have asked to see the same of our daughter's account. He refuses saying I should trust him and that I am controlling. He also will not show proof of his life insurance policy. The MSA does state that the policy shall remain in force with the children as primary beneficiaries.

It is my understanding that Maine and other New England states have a process for a supplemental hearing after a judgment. That has to be done by filing garnishment papers with the court and serving them on the debtor's employer. It is not requested at the supplemental hearing.

So you will probably end up doing more time than you would have if you had just originally agreed to go to jail (at least this is what my clients end up doing in your situation). I would recommend speaking with the lawyer who put you on probation for more specific advice.

You should be "served" with legal papers. You need to file a document called "Answer" with the court basically stating that you don't agree. Make 3 copies - keep one & send one to the person (or the attorney). Get a file stamped copy of the document to show that you filed it. You can go and read the court's file in the courtroom since it's public information.

There are forms in the Texas Family Practice Manual that most attorneys use. These are the master forms and you need to modify them to suit your case. Look in a law library for this set for form books. I also recommend reading the Texas Family Code.

Odometer fraud generally involves tampering with the odometer in a manner which results the reporting of lower miles than what has actually been accrued. Based on your description the buyer inspected the vehicle and agreed to purchase the bike "as-is" following the inspection of the bike. If the odometer shows the correct mileage then he should have noted that at the inspection.

When he started making payments again, I told him that if he dropped off the scene again, I would go forward with a request to terminate his parental rights. He said he understood - that he can't bop in and out of their lives. I have no way of contacting him, and have remarried. My children know only their stepfather as daddy because their bio dad has been too busy doing drugs and drinking to contact them or pay support. I want to terminate his rights and my new husband to adopt the children. New husband fully understands that this would obligate him to pay child support should we split up, and I know I would have to share custody with him. Having said that, I cannot figure out where to file what. Does Arkansas have jurisdiction over the termination and California over the adoption, or can I do both in California?

It depends on how long the children have been here. If you have been in California a couple of years, I would go ahead and file here. Over time the gravity (for lack of a better word) shifts and it is a case by case analysis weighing the nexus between the children and the state. The longer they are in their new state the more they have ties to it. I would simply file here and let the father fight jurisdiction. The fact is you and the kids are here and as long as you didn't abduct them, California should be the more convenient forum. So short answer is California should have jurisdiction over both issues. The termination of parental rights would be done with the adoption proceedings.

In the past 4 years I have had to provide my POA document over and over, and that office claimed I never provided it even thought I stood by our advisor, a VP at the company, when he copied it. I called their corporate office and they had me fill out a POA in full force and effect document. I thought all was fine but yesterday received a letter from the branch manager saying I have to remove the accounts, which includes the family trusts of 3 million dollars within 30 days or they will liquidate it and send me a check. Is this legal? We had asked for a new advisor prior to this but this was not done.

IF he is charged with a felony the prosecutor has four years, unless the felony is super serious (murder, armed robbery, rape). You never mention the charge in your question. In regards to the bond in 90 days. There is no automatic bond that is set after 90 days, IF there is no indictment. Your husband's attorney must keep up with the 90-day date, and file a motion to have the hearing scheduled for sometime after the 90th day. You need to have the charge dismissed or amended to some charge which is not a variety of theft, as shoplifting is. My responses are general in nature, and additional info and research is needed. You really need to have an attorney and insurance representative look over everything. Merely relying on a quick online response is not going to protect you in the long run. In addition, you are probably going to have to comply with various state regulations and city ordinances.

First, it is legal to drive someone else's car with his permission.

Second, you should discuss potential liability with your business's insurance company. You are going to need insurance, and you carrier would have a good idea how to structure it.

Third, intoxication may be an affirmative defense to the validity of a contract. At first blush, however, I would not worry about this too much. I am guessing your are going to collect your fee at drop off. Cops have individuals under the influence sign paperwork every night.

Seek legal help. Appointing someone as POA does not mean that the individual gives up all their rights. They cannot be controlled by the individual with the POA. Most POA's provide internally for them to be withdrawn and they specify how that can be done. It needs to be in writing and copies provided to anyone who is operating under the assumption that it exists. If the POA was recorded somehow then a withdrawal of that POA needs to be recorded as well. The individual can make new living wills, health care surrogates and last wills anytime he wants and they would take priority over any prior ones.
