What is the age for stopping Child support in the State of NJ.
Answer
New Jersey is one of the few states that doesn't automatically terminate child support when the child turns 18. Whether child support is terminated and the child emancipated (meaning, an adult no longer requiring their parents' support) is dependent on the circumstances. If the child is over 18, graduated from high school, and working full-time or not enrolled in college full-time, then there's a good chance the child support is going to be terminated. At that point, the parents can choose to end child support and enter into a written agreement that's submitted to the Court and Probation (if support is paid through Probation), or the parent who pays support can file a motion for emancipation with the Court. It really depends on the circumstances. Answer
There is no age when it automatically stops. You have to ask the Court to stop it.
I had a cousin who paid until his daughter was 25 years old, before he came to me and I had the Court put a stop to it.
It is much too complicated, but that is what the law is in NJ.
I can explain things in detail. Why don't you come see me. I will meet with you and go over your situation. I will explain what legal issues I see, and what I can do to assist you. I will also give you my best estimate of the cost for attorney's fees.
This will be a free consultation. After we talk, you can decide what you would like to do.
Give me a call, make an appointment to come see me, and let's get moving on this for you. No charge for the telephone call and no charge for the first office visit.
