If you mean can he do anything because of the roommate, the answer is that New York has a right-to-roommate law, Section 237-f of the Real Property Law. A lease to X as tenant means that the property can be occupied by X, his immediate family (mother, father, spouse, children) and one more person. However, there has to be at least 100 square feet of living space per person in the apartment.
