Question

I lost a deed of trust on a commercial property I own through a C Corporation. The property is in California. How do I get a new deed.

Answer

Deeds of trust are almost always recorded with the County Recorder. Go to the Recorder's office with sufficient information to identify the property, and have one of the clerks assist you in locating and copying the D of T. Usually, it'll be helpful to have the assessor parcel number and the approximate date the D of T was created. I'd also try to avoid going to the Recorder's office right after it opens or right before it closes, as the clerks are more likely to be busy with title company recording work at those times.

Answer

If the deed of trust was recorded, you can get a copy, and a certified copy is admissible in court. If the deed of trust was never recorded, then you have a major problem and need to speak to a competent real estate attorney immediately.

Question

My son took a deal for 7 years of jail time and no probation, If the judge grants a mitigated sentence can she go above the total of 7 years with jail time and probation ?

Example: if she were to reduce it to five years of jail time can she go above 2 years of probation ( over 2 years would be more than the 7 year deal he signed )

Thank You

Answer

Yes, the judge could because probation is considered a privilege and therefore, the judge could decide less jail time and more probation.

Question

In Illinois, if I give two weeks notice and then am walked after 3 days, is the employer legally obligated to pay me through the two week period? Also, if the days I worked fall under a new pay period, is there a minimum amount they have to pay me for the week, being a salaried employee?

Answer

As a salaried employee, they should pay you for every day that you showed up, regardless of how many hours you worked on that day. You are not entitled to any compensation for time after you "walked".
