Question

I had an affair with a married woman that resulted in a child. I no longer live in the same town as mother and child. I did not know of child till I was served with child support papers three years later. i have had no contact with them since they were born. I have been paying child support and providing medical insurance as required. Mother is taking me back to court to have my rights taken away and to name her mother as a joint managing conservator. In our first court hearing the judge did not listen to the case because she was still legally married to her ex-husband and because he was presumed father. They have since divorced. What are the chances that my rights with be taken away? Will this stop child support?

Answer

I would strongly urge you to talk to an experienced family law attorney in your county immediately. Look on this website and on www.avvo.com for an attorney in your area.

The grandmother could be added as a third conservator without terminating your rights.

If you are paying child support and provide health insurance, the judge might not terminate your rights. But you need an advocate on your side to help you in this complex case.

Good luck!

Question

My father died in n.y. and I am the sole living remaining son beneficiary on his met life $5,000.00 whole life insurance policy.

Dad will be cremated and the funeral home accepts full payment from the Met Life policy. I am to receive the net proceeds money difference in the form of a check from Met Life. The funeral home said they would help me with the paper work and death certificate, but i need to know when I get the Met Life check made payable to me, is it exempt from probate, as the estate will be going into probate soon.

Does anyone know how long it would take to receive the check after what is needed is submitted to Met Life?

Thanks so much.

Answer

Q. but i need to know when I get the Met Life check made payable to me

A. Generally, if you are the beneficiary of a life insurance policy, you would simply have to complete the insurance company's internal form and submit a dealth certificate. I would directly contact Met Life. The time for payment by the insurance company is usually several weeks.

Q. is it exempt from probate, as the estate will be going into probate soon.

A. Yes. The funds received from the life insurance policy is not subject to probate.

Mike.

Question

As Trustee, I may loan money to the trust for any purpose, which is allowed by the language of the trust, at "the then current rate of interest." The loan becomes a "first lien against the assets of the trust." What is "the then current rate of interest"? Are we talking AMEX cash advance rates in the 20% to 30% APR, or mortgage rates in the 5% to 9% APR range? (It just so happens that the trust's current main asset is commercial real estate.)

Answer

The current rate of interest is the rate set by the Federal Reserve Bank of the United States; visit their web site for the rate on any particular day.

Answer

That depends on the nature of the loan. Are you making an AMEX type of cash advance? Are you providing a secured real estate loan? What is the loan structure and why is it being done? What is the credit structure of the trust? Is this a short term loan? Long term? Who are the beneficiaries? Will the debt also be theirs, or will it be paid before distribution? Is the grantor still alive and with capacity so he or she can set terms?

Answer

The rate depends on many factors: secured versus unsecured being the most important. If unsecured, then the person better be very credit worthy or the amount not particularly significant or else you may not be acting in a manner befitting a fiduciary. Also, I am assuming that you are not the potential borrower. Overall, it seems that the trust owns significant assets and it is probably a good idea for you to consider having an attorney to represent you as trustee. I would be happy to assist you with these sorts of trust administration issues.
