Question

In nh, is recording a conversation at work ok to do? Provided it is made to prove that you are being bullying in the work place.

Answer

No, not without very specific authorization to do so. There is a statute in NH called the Wiretapping and Eavesdropping statute, RSA 570-A:2, which prohibits recording of conversations without the permission of all parties to the conversation. In fact, it is a felony to record conversations without carefully adhering to the statute. There is a mechanism for the AG's office or a County Attorney's Office to authorize such a recording with the consent of one of the parties to the conversation and where there is a showing that the conversation is likely to yield evidence relating to a number of specific criminal offenses. Every circumstance varies, I do not know the facts of your particular situation and, accordingly, this is not legal advice. Rather, it is a general statement regarding the law in this area. For specific legal advice, you should consult with an attorney. Good luck.
