If someone signed a waiver while emotionally unstable, could the waiver be illegitamite?



Answer

The question is whether the person is so incapacitated that they cannot legally be bound to any contractual agreements which they have made. Emotionally unstable does not necessarily mean that the person lacks the capacity to enter into a binding agreement, including a waiver.
