Will I be successful if I already have a Community Partition Judgment and have been allocated half of my former spouse's pension benefits when available but also want his pension benefits from his new job position, in which he began 6 months prior to our divorce decree issuance? Am I also entitled to receive some amount, even if he was only working there 6 months before our final divorce decree was issued and we had already been declared separate and apart in our property when he began this new, out of the state of Louisiana position?



Answer

If you were already ordered by a court as separated prior to receiving a divorce or community property division, he owes you no part of his new job's pension proceeds.
