Question

I was charged with disorderly conduct with a DV tag in 1999. Now that it is 12 years later, I would like to have it expunged. Can this be done? I have not had anything on my record since then, and did not have anything prior. Thanks for your reply.

Answer

If it was a straight conviction with the DV finding, the answer is no - with the exception of either a Presidential or Governor's pardon.

If you took a plea deal, it depends on the plea deal - for example, most successfully deferred sentences can be expunged as long as the agreement did not contain a specific section whereby you gave up your right to seal.
