I was rear ended by a uninsured driver who did not own the car he was driving. He fled the scene. There we no injuries.

He also had a suspended license. The other insurance company has not been able to contact the owner of the car and has said they still investigating the claim. I since had the car repaired by my insurance company since I need the vehicle. Do I have a case against the car owner and his insurance company?

Based upon the facts you described, you have a claim against the driver. You might have a claim against the vehicle owner, if they knew that the driver had no license.
