"Firstly: I'm non U. S. citizen. I was arrested in Massachusetts in august 2010 and got pretrial probation for 1 year. I have paid the charge (fine) of this issue. I'm going in the USA again (B-1 visa) this summer and i have a question. What i have to answer in the ds-160 application for Embassy about arrest ("have you ever been arrested..."). My lawyer said: "You should not as it was pre-trial probation. It was an arrest but was disposed of on the most lenient terms possible in Court absent dismissal. I am unfamiliar with filling out of documents at the Embassy." I don't want to lie to consul and want to know reliable information. Thank You for any information.



Answer

You must be truthful about any arrests regardless of outcome. You will most likely need to supply some evidence of the disposition of the case which you can get from the court if you don't already have it.
