I own a house in new jersey that I would like to move into. The current tenant does not have a lease and refuses to move. I gave her a verbal notice 5 months ago but she still has not moved. I told her het deadline was September. She is a month and a half behind in rent. I am not collecting rent because I do not want to imply that I want to continue renting her the property.



Answer

You will have to file for eviction in Landlord/Tenant court. It is unlawful in NJ to evict a tenant yourself and, if you do that, you may be liable to the tenant for damages even though she owes rent.
