Question

First I want to thank Lawguru and the Attorney's that take the time to read and respond. Knowing very little about the "Law" and not being able to afford to bring questions to a local attorney, the service you provided is very much apprecitated.

The Question: On 10/19/12 I posted a question and did receive a response that was encourging. When I suggested to my court appointed attorney I realize my only defense is to hope we can argue that the law enforcement officers did not follow proper procedure when they arrested me, he was very nonchalant about my defense. How can I encourage the court appointed attorney to stand up for my rights, is he required by statute and if so which one?

Yours is a common problem with court appointed attorneys. You've likely heard the old saying that you get what you pay for. It is a good idea to figure out a way to hire a more aggressive attorney that you have more confidence in. Many court appointed attorneys know how much they are worth and they get paid accordingly.
