Is it legal to take a album-cover picture, edit it, and make it into a t-shirt? (I am not in any way, shape, or form selling this t-shirt)

Question

Is it legal to take a album-cover picture, edit it, and make it into a t-shirt? (I am not in any way, shape, or form selling this t-shirt)

Answer

It's technically a copyright violation.

Answer

As a Franchise Attorney I agree with the other attorney answer. Noncommercial use is not a defense to copyright infringement. Generally, when you make an authorized copy of a copyrighted item, it's copyright infringement. Consult with a good intellectual property or franchise attorney in your area for specific advice.

Answer

I think Mr. Murphy meant ".... when you make an UNauthorized copy..."

In any event, I agree that it's a copyright infringement, but your chance of being sued over it is extremely small.
