If I was named beneficiary on my son's life insurance who just passed away and he owed back child support are those funds subject to that outstanding debt?
Answer
theoretically, the money ceases to be part of the son's estate the second he dies, and belongs to the beneficiary. My view is that it belongs to the beneficiary.
