Can a person record another person without letting them know, and then sue?

Question

Can a person record another person without letting them know, and then sue?

Answer

In CA recording a conversation without first getting permission or letting the other person know the conversation is being recorded is a criminal violation and is inadmissable in civil court. That means you can object to its introduction as evidence in a civil proceeding. So the recorded conversation can not be used as the evidence to sue you. Contact me if you have additional questions. Answer

It is a felony to secretly record others without their knowledge, UNLESS you are doing so to document their participation or planning of an actual crime, which you intend to report to law enforcement.
