Child Support/Guardianship
I am currently paying child support for a child that I don't spend any time with (baby mama drama). I also have a ten month old son that does live with me and I just received legal guardianship for my 15 year old brother in law. Since I now have two other children to support, would this qualify me for a reduction in child support? I understand that cases are reviewed every three years so I assume there will be a review in October of this year. Thanks!

The child which you are a guarian for does not qualify as a hardship. The 10 month old qualifies as a hardship if it is an extreme hardship. Different judges and jurisdictions may apply that hardship differently. Talk to a child support attorney in your county for more information. The court does not automatically review child support cases. If this is being enforced by the Department of Child Support Services they may have a procedure where they will review the case. Again, a consultation with an attorney in your county would be worthwhile. Good Luck, Pat McCrary
