My mother has literally just been in a car accident; though all logic points in the direction that the wreck was caused my the other party. The police woman spent more time with the other party though my mother was hurt. My mother was given a ticket and not the other party.
The only question my mother was asked was "where were you heading" - and nothing else.
What do we do to file a claim? How long does it take usually? Should we hire an attorney or go to claims court on our own?
Our car is totaled.

You should hire an attorney. Clearly there is something going on that needs an expert to deal with.
